TRANSPORTATION OF PELLETS / FINES ON TONNAGE BASIS – AMNS PLANT TO STOCKPILE AND VICE VERSA 1.1. Materials Material Description Approx. Tonnage per Annum Job Scope Iron Ore Pellets / Fines 45,000 MT 1. Pellets/ Fines loading into the dumpers. 2. Pellets/ Fines movement / transportation from AMNS Plant to Stockpile and vice versa 3. High stacking of Pellets / Fines at unloading point. * Unloading Points – ArcelorMittal Nippon Steel India Limited Plant to ArcelorMittal Nippon Steel India Limited Stockpile and vice versa (5 km approx. from ArcelorMittal Nippon Steel India Limited Plant to Stockpile). Recommended year of vehicle manufacturing should not be earlier than 2016. All the transport vehicles should be equipped with Global Positioning System (GPS). 2. Conditions of Operation: 2.1 Transportation of Iron Ore Pellets from ArcelorMittal Nippon Steel India Limited Plant to ArcelorMittal Nippon Steel India Limited Stockpile and Fines/ Filter cake from Stockpile to ArcelorMittal Nippon Steel India Limited Plant. 2.2 The material movement should start immediately as and when informed by ARCELORMITTAL NIPPON STEEL INDIA LIMITED Engineer, for the uninterrupted production of the plant. Production should not be affected on account of delay in Pellets movement. 2.3 The above-mentioned equipment should be mobilized within a span of 1hour after intimation. In case of breakdown, contractor has to provide Alternative /Equivalent capacity machine immediately within 1hour without any delay. 2.4 Contractor should take high safety precautions to ensure no spillage while transportation. Shifting includes providing trucks for shifting, loaders for loading at the above said areas. Cargo moves from ArcelorMittal Nippon Steel India Limited plant as per the instructions given by ARCELORMITTAL NIPPON STEEL INDIA LIMITED Engineer to accommodate the cargo. High Stacking at unloading point to be done. If contractor could not deploy loader for loading at unloading point and in such cases if AMNS will provide Loaders charges will be deduct from the contractor bill. Water sprinkling periodically on the roads during the transportation period of cargo from the respective areas for dust suppression if required. Sprinkling shall be done minimum 2 times in every shift. If sprinkling not done in any of the reasons the cost incurred for sprinkling the same will be back charged to the Transporter. 2.5 Contractor should perform the duties as per the guidelines given by the concerned ArcelorMittal Nippon Steel India Limited Engineer. If the instructions of the Engineer not followed then, the cost incurred for the activity will be back charged to the Transporter. 2.6 Job should be completed in coordination with our Logistics department and Material Department for weighment of the cargo. Also, high stacking to be done at unloading point with caterpillar. Prevention of Spillages during transportation from respective areas is in contractor’s scope. If any loaded dumper found missing and does not report to our plot, then the cost of the material will be deducted from your bills based on the basic cost of the material. 3. Other Terms and Conditions: - 4.1. Period of Contract <(>&<)> Termination The Service Order will be valid for one year and shall be extended for one more year with the same schedule rates, terms <(>&<)> conditions and upon satisfactory performance during the contract period. The services can be terminated by ARCELORMITTAL NIPPON STEEL INDIA LIMITED by giving 30 days advance notice during its currency without assigning any reason whatsoever and without there being any liability on us, what so over on such termination. 4.2. All vehicles / equipment must necessarily be in good working condition, especially brakes. Rear door of the dumper should be closed completely without Gaps and connected Hydraulic system should be in good working condition. The personnel with valid driving license must drive them. The registration certificate and driving license must be kept in the vehicle itself enabling the authorities concerned to check, when required. In any case, the contractor shall not depend on the company or Visakhapatnam port trust for making such equipment’s available to him and it will be his sole responsibility to organize these equipment’s. 4.3. No guarantee is given by the company as to any definite volume of work that may be entrusted to the contractor during the period of tenure of contact and / or at any point of time and the company does not accept any liability on this score. 4.4. All the Vehicles for transportation to be deployed for the above shall possess all requisite documents as per Andhra Pradesh Motor Vehicles Act. If any vehicle found violating the above a penalty of 10% of the Unit rate of material in movement. 4.5. All the vehicles shall have side Indicator Lights, Reversing Horn. Any Vehicle found on surprise inspections during execution of the work will be suspended from entering our plant premises and the charges for deploying of other’s vehicles by ARCELORMITTAL NIPPON STEEL INDIA LIMITED will be deducted from the bills. 4.6. The service provider shall take utmost care not to spill the cargo while shifting from Outer harbor to our Plant / plant. 4.7. You need to keep in touch with our plant operating personnel for mobilization of trucks and equipment where advance information more than few hours is practically not possible. Hence the time for mobilization shall become one of the key criteria for selection of an agency and the performance of the contract for future renewals will depend on the efficiency of the agency for such mobilization 4.8. The rates of the contract are firm for a period of one year 4.9. Payment Terms: You shall submit monthly bills for transportation and Vessel/cargo related bills immediately on completion duly certified by concerned ARCELORMITTAL NIPPON STEEL INDIA LIMITED authorities. Certified bills will be paid within 30 days of approval. 6. Period of Contract: Contract is valid for 12 months. However, based on the performance the contract is extendable from one more year based on mutually agreed terms. 7. Arbitration: In case of any disputes arising under this Contract, then the same shall be tried by the Courts/Tribunal within the Jurisdiction of the city of Vizag. The disputes shall be subject to the provisions of the applicable Indian Laws, the rules of the State of Andhra Pradesh <(>&<)> that of the Local Authorities. 8. Safety, Health <(>&<)> Environment: 8.1. Contractor and his workmen shall abide by all Safety, Health and Environment rules and regulations of ARCELORMITTAL NIPPON STEEL INDIA LIMITEDSTEEL LTD. Any violation of the safety rule shall be viewed seriously, and contractor shall be penalized as per ARCELORMITTAL NIPPON STEEL INDIA LIMITEDSTEEL LTD rule. 8.2. Contractor workmen shall have to obtain Gate pass before commencement of work, which shall be issued only after getting safety training <(>&<)> guidelines from ARCELORMITTAL NIPPON STEEL INDIA LIMITEDSTEEL LTD safety officer. 8.3. All safety equipment as per statutory requirements like helmets, safety shoes, safety belts and any other specific safety equipment required for the work will have to be provided by the Contractor to his EMPLOYEES AT HIS COSTS. 8.4. Contractor shall have to ensure minimization of pollution at source through environment friendly processes, techniques. 8.5. Before starting the work, contractor shall submit detailed work program, milestone of Different activities, safety <(>&<)> quality plan and any other relevant documents required For the work to the Engineer-In-Charge for his approval, after which work shall be Started as per the approved program. 9. Discipline: The contractor and his workmen shall have to follow ARCELORMITTAL NIPPON STEEL INDIA LIMITED’s standard Code of Conduct and the Law of the Land. It shall be Contractor’s responsibility to maintain and keep the deployed manpower in specified area only. If the contractor or his workmen is found violating the same or participating in unlawful activities or influencing ARCELORMITTAL NIPPON STEEL INDIA LIMITED staff by any offerings or other inducements, the contract shall stand terminated with immediate effect. 10. Force Majeure: In case force majeure is established and one party informs the other promptly of such Occurrences, no increase in price and / or any claim shall be made by the contractor. In case of very prolonged force majeure condition exceeding 30 days, the parties shall mutually discuss and agree to the future course of action.
