The pellets that are stacked in plot 6 of stockpile are transferred to ships through shipment conveyor with the help of 4000 TPH reclaimer dedicated for clearing plot 6. The reclaimer was erected <(>&<)> commissioned in the year 2008 by M/s Sandvik Asia Ltd. Scope of Work: Agencies are invited to undertake the AMC of the 4000 TPH capacity reclaimer in our stockpile located at Visakhapatnam Port Trust to ensure 98% availability of the reclaimer for shipment <(>&<)> trouble free operation. Space will be provided by AM/NS India to the agent to keep necessary tools, tackles, of the agency. However safety of those will be the responsibility of the agency. 19. Income Tax as applicable under the provisions of the income tax act shall be deducted from payment bills of the agency before making the payment. 20. The agency shall observe highest order of discipline while execution of this order 21. The agency shall follow the Government rules and regulations. 22. The agency alone shall be responsible to cover the statutory requirements like PF, ESI workmen compensations (general), etc., for the personnel deployed for the above job. 23. Payment Terms: The amount shall be paid on monthly basis. The party shall submit the invoice to concerned Head-maintenance for certification and the supporting documents should be duly certified by the respective area in charges. Payment will be made in min15 days after submission of clear bill. Taxes <(>&<)> Duties: All the applicable taxes <(>&<)> duties will be reimbursed extra at actual. However the applicable income tax shall be deducted from bill of the contract/ agency as per the applicable rates. Penalty: Proportionate deduction will be made in case of less deployment of personnel/ Frequent delays in commencement of shipment due to improper job planning. The daily log sheets need to be certified by the Area engineer at the end of the day which becomes a mandatory supporting document for approval of monthly invoices. In case of when any incident happened due to lack of attention / negligence of operators and their shift supervisors towards their regular duties, penalty on mutual agreed terms shall be imposed on contractor. If there is no improvement further, then penalty will be imposed at the discretion of our engineer in charge or it may lead to termination of contract. Validity of work order: One year effective for a period of 01 year and is extendable by one more year at the same service. Any Increase in A.P Minimum wages is to be scope of contractor and no extra payment will be made by AM/NS India. Termination of work order: AM/NS India reserves the right to terminate the contract at any point of time with one month’s notice if:(i). agency fails maintain manpower availability consistently /performance falls below the mark consistently as assessed by a group of engineers. The party shall be solely and exclusively responsible for any claim arising out any accident to their staffs and self-indemnify protect and save the company against loss from any and all claims, demands, actions and proceedings whatsoever instituted against the company by the party’s staff or their legal representatives or assigns together with any all fees costs and expenses incurred in respect thereof. The party shall not have the right to claim any relief against the company in respect of any accident or loss suffering by its staffs. 8. The party alone will be solely responsible for the compliance with all laws, Local, State or Central applicable to the party and their staff and will be solely responsible for the consequences arising out of non-compliance with any of them. 9. The party shall comply with all operational rules and regulations including such safety and security rules as may be framed by the company from time to time and made applicable to the company premises, wherein the party or their employees happen to be operating under this contract. In the event of any of the party’s employees violating the said rules and regulations or in any way of becoming objectionable to the company, the party shall remove forthwith the such employees from the service. 10. The party shall provide at their expense Employees State Insurance and such other Insurance, willfully ensure their obligation under any applicable statute of any jurisdiction in which the personnel happen to be employed by the party for service under this contract including such employer’s liability insurance as is necessary to fully protect and indemnify any liability towards and any such employee under any law in force for the time being. 11. In consideration of the efficient and satisfactory performance on part of this agreement by the party, the company shall pay the party in lump sum per month for the work performed during the preceding month. 12. The party shall guarantee faithful and efficient performance of this contract and ensure full responsibility in respect thereof. 13. In the event of non – compliance by the party, or any of the provisions contained herein, the company shall be at liberty to comply with the same and recall the cause, thereof from the compensation payable to the party. In the performance of the work defined under this contract it is agreed that the party is not the agent of the company and that the party shall not bind the company in any manner except as otherwise provided under this contract, or as specified by the company in writing to the party. 15. The contract shall not be assigned, subjected or transferred in full or in part, by the party expect with the prior written consent of the company. 16. The contractor shall obtain a license under the contact labour (R <(>&<)> A) act. 17. The contractor shall comply with all relevant provisions of various labour laws, such as factories Act, Gratuity Act, Bonus Act, EPF Act etc and relevant rules there under. 18. The contractor shall maintain properly all the registers and records, statutory or otherwise and fulfill such other requirements as may be provided for by the relevant states and shall comply with the statutory provisions from time to time. 19. The contract employees should wear uniforms and safety shoes .Any worker of the contractor not found in proper neat and clean uniforms shall be removed forthwith from the factory premises. 20. Notwithstanding anything contained herein, the contractor’s staff shall, for all purposes and intent, be regarded as the contractor’s permanent workers and shall not be under circumstances construed to be in any way connected with AM/NS India. 21. The Contractor shall provide the staff with his own Identity Cards which should be used at gate entry point as entry pass, as well as for the purpose of attendance punching system for record and regularization of employees’ attendance.
