Loader specifications and recommended make <(>&<)> Year of Manufacturing are provided below. § Diesel/HSD shall be arranged by the contractor only. Diesel, Lubricants, other consumables, and spare parts are to be arranged by contractor. § Recommended Year of Manufacturing for Equipments is not older than 6 years (Year 2018 and above is preferred). All Equipments must be in good operating <(>&<)> Safe condition, registration certificate of the same to be submitted along with quote. § Breakdown Clauses Applicable as mentioned in the Terms below. § One day in a month is provided for maintenance with prior consent of Engineer In-Charge § Boarding <(>&<)> Lodging for Operators and supportive manpower shall be under contractor scope only. Note-1 (Payment Condition): Rate with HSD = Initial Finalized Price HSD Component is 35% of Initial Finalized price <(>&<)> HSD Component subjected to vary as per trailing diesel escalation/de-escalation clause. Contractor must submit request letter along with necessary backup of changes in diesel prices as per below formulas for contract unit rates revision. The party shall submit the invoice to concerned authority for certification and the supporting documents should be duly certified by the respective area in charges. Contractor must upload monthly invoice in portal as per the AMNS guidelines. 02) Three operators per Loader shall be provided by the contractor to facilitate 24 hours working and 30 days/month in plant for operation of equipment. If required stand by operator may be provided by the contractor at his own expenses to ensure equipment availability. The operators are to be supported by sufficient helpers during operation of the machines. Minimum one helper per each Excavator <(>&<)> each Frontend Loader to be provided. The operators to perform as per the directions of our Engineer at site. In case there is no operator available to operate the equipment, the same period shall be considered as Break down period. If repeatedly operator is not available contract shall be terminated by M/s AMNS without any notice to the contractor. 03) Diesel <(>&<)> operator availability to be ensured by the contractor / supervisor on daily basis and same to be updated to Engineer – In-Charge. Non availability of machine for want of diesel/operator unavailability will be treated under Break down. 04) Equipment Maintenance schedule/plan should be submitted to Shift In-Charge as to have equipment in healthy condition. Without submission of maintenance schedule plan, equipment cannot be released for maintenance. 05) Details of Equipment’s (Make, Capacity, Model and Year of Manufacture) owned by the Contractor to be furnished for reference. All equipments shall carry valid licenses/equipment fitness certificate/insurance documents and shall strictly operate as per the state/central govt. guidelines and transportation rules/acts and as per the permissible carrying loads only. 06) The equipment should be fit with proper braking, lighting, horn, reverse horn system, rare view glasses etc., Contractor must ensure proper working of all these from SAFETY point of view 07) Machine should be available for 24 hours a day. Equipment shall be available all the time at our site only so that it can be used in case of emergency works. Contractor must ensure availability of the operators during shift change over time (relieving time). Medical fitness certificate for operator to be submitted yearly once. 13) Disobedience of orders, obstructions shall not be tolerated. The operator / driver should work as per the directives by companies / AMNS’s representatives. 14) Contract can be terminated at any point of time with 07 days prior notice within the contract period. 15) Co-ordination, Liasoning <(>&<)> Administration with all govt <(>&<)> non-govt agencies/Public issues if any is under scope of c ontractor. 16) The party should make their own arrangements of accommodation and transportation to their personnel deployed at site. 17) The party will observe highest order of discipline while execution of this order. 18) M/s AMNS reserves the right to distribute the above job among more than one successful bidder. 19) Contractor is sole responsible for all risks in executing the contract, M/s AMNS is not responsible for any claims arising either from the contractor or any third party. 20) As per EMS policy of M/s AMNS, pollution check certificates to be obtained from PCB and to be submitted by the contractor as and when required as per the PCB norms 21) Diesel Entry record book at gate to be duly filled by contractor <(>&<)> record of diesel consumption/filling along with diesel bills to be submitted by contractor along with monthly invoice. 22) Speed limit is 20 KMPH should be maintained for equipment within plant <(>&<)> premises. 23) No Mobilization <(>&<)> Demobilization of the Equipment charges shall be paid. 24) PF/ ESI Insurance documents to be submitted to AMNS by Contractor for all working crew 25) Contractor should not disclose any information connected with AMNS Company. If any such incidents observed, AMNS has the right to take necessary disciplinary action against contractor. Break down /Period of Non-operation of the equipment: 1. The un-planned stoppage of the equipment, due to any reason (men/machinery), during work is considered as breakdown. If the equipment is under breakdown for any reason, the contractor must provide an alternative machine. The rate for the alternative machine depends on its capacity which must be discussed before placing the machine. a. The break down hours/days will be recorded in shift logbook and to be submitted in daily report sheet along with the bill. b) The number of occurrences of break down during the billing period is also to be recorded. c) Up to 24 breakdown hours – no deduction. d) From 25 - 48 breakdown hours –deduction will be 5% of the bill amount of that month. e) From 49 -96 breakdown hours -- deduction will be 7.5% of the bill amount of that month. f) Above 96 breakdown hours in a month, payment will be made for actual run hours where Minimum run hour’s payment condition is not applicable. And deduction will be 7.5% of the bill amount of that month. f) Equipment idle for want of Diesel / operator will also be considered as break down. Note: BD clause to be considered individually for the loaders 4. The contract is liable for termination without notice period, if a) The number of break downs is more than three times in a month. b) Prolonged breakdown for more than two days and alternative is not arranged by the contractor starting of third day. AM/NS reserves the right to terminate the contract on above grounds. c) Violation of Safety Norms/Guidelines of AMNS Framework (with immediate effect) 5. The engineer In-Charge is final authority on deciding the total breakdown hours. Period of Contract: The contract is valid for one year from the date of work order / LOI issued, which may be extended for one or more year(s) on existing rates, terms, and conditions, upon satisfactory performance and mutual consent. Responsibility to any loss: The successful tenderer will have to submit an undertaking at the time of award of contract that any loss, accruing to the property, during the contract period (and extensions, if any), will be borne by the contractor at his own cost. The assessment of damage made by AMNS is final. Insurance: Since it is insurgent area, the relevant insurance of men and machinery is in the scope of the Contractor. AMNS is not responsible for any loss or damage of any kind. Arbitration: In case of any disputes arising under this Contract, then the same shall be tried by the Courts/Tribunal within the Jurisdiction of the city of Vizag. The disputes shall be subject to the provisions of the applicable Indian Laws. The operator / driver should work as per the directives by companies / AMNS’s representatives. 14) Contract can be terminated at any point of time with 07 days prior notice within the contract period. 15) Co-ordination, Liasoning <(>&<)> Administration with all govt <(>&<)> non-govt agencies/Public issues if any is under scope of c ontractor. 16) The party should make their own arrangements of accommodation and transportation to their personnel deployed at site. 17) The party will observe highest order of discipline while execution of this order. 18) M/s AMNS reserves the right to distribute the above job among more than one successful bidder. 19) Contractor is sole responsible for all risks in executing the contract, M/s AMNS is not responsible for any claims arising either from the contractor or any third party. 20) As per EMS policy of M/s AMNS, pollution check certificates to be obtained from PCB and to be submitted by the contractor as and when required as per the PCB norms 21) Diesel Entry record book at gate to be duly filled by contractor <(>&<)> record of diesel consumption/filling along with diesel bills to be submitted by contractor along with monthly invoice. 22) Speed limit is 20 KMPH should be maintained for equipment within plant <(>&<)> premises. 23) No Mobilization <(>&<)> Demobilization of the Equipment charges shall be paid. 24) PF/ ESI Insurance documents to be submitted to AMNS by Contractor for all working crew 25) Contractor should not disclose any information connected with AMNS Company. The un-planned stoppage of the equipment, due to any reason (men/machinery), during work is considered as breakdown. 2. Equipment is allowed for planned maintenance with prior permission of engineer In-Charge. 3. If the equipment is under breakdown for any reason, the contractor must provide an alternative machine. The rate for the alternative machine depends on its capacity which must be discussed before placing the machine. a. The break down hours/days will be recorded in shift logbook and to be submitted in daily report sheet along with the bill. b) The number of occurrences of break down during the billing period is also to be recorded. c) Up to 24 breakdown hours – no deduction. d) From 25 - 48 breakdown hours –deduction will be 5% of the bill amount of that month. e) From 49 -96 breakdown hours -- deduction will be 7.5% of the bill amount of that month. f) Above 96 breakdown hours in a month, payment will be made for actual run hours where Minimum run hour’s payment condition is not applicable. And deduction will be 7.5% of the bill amount of that month. f) Equipment idle for want of Diesel / operator will also be considered as break down. Note: BD clause to be considered individually for the loaders 4. The contract is liable for termination without notice period, if a) The number of break downs is more than three times in a month. b) Prolonged breakdown for more than two days and alternative is not arranged by the contractor starting of third day. AM/NS reserves the right to terminate the contract on above grounds. c) Violation of Safety Norms/Guidelines of AMNS Framework (with immediate effect) 5. The engineer In-Charge is final authority on deciding the total breakdown hours. Period of Contract: The contract is valid for one year from the date of work order / LOI issued, which may be extended for one or more year(s) on existing rates, terms, and conditions, upon satisfactory performance and mutual consent. Responsibility to any loss: The successful tenderer will have to submit an undertaking at the time of award of contract that any loss, accruing to the property, during the contract period (and extensions, if any), will be borne by the contractor at his own cost. The assessment of damage made by AMNS is final. Insurance: Since it is insurgent area, the relevant insurance of men and machinery is in the scope of the Contractor. AMNS is not responsible for any loss or damage of any kind. Indemnity: Contractor shall keep AMNS indemnified from all liabilities, CLAIMS resulting out of this contract and ANY act of Contractor workman, including but not limited to taxes <(>&<)> duties, damages, penalties, fines, punitive measures, LEGAL COSTS fees etc. of whatever nature due to non-compliance by contractor in his scope of the applicable statutory laws, rules, notifications etc. In case force majeure is established and one party informs the other promptly of such Occurrences, no increase in price and / or any claim shall be made by the contractor. In case of very prolonged force majeure condition exceeding 30 days, the parties shall mutually discuss and agree to the future course of action.
