Tender For 2000157594-Shifting Of Sludge From Corex 2000157594 10 10 10 SHIFTING OF SLUDGE FROM COREX 145,000 TO Email : GOPAL.AMETA@AMNS.IN Contact : Name : Gopal Ameta Item Details : Annexure – 1 (SOW including Penalty Clause) Scope of Work- Vendor: - LOADING AND SHIFTING OF SLUDGE Area Of Work: COREX TECHNICAL Ø In case of direct evaluation by secondary sales not taking place vendor has to transport sludge to the location identified by the byproduct management/Secondary sales within 10KM radius from the Corex sludge pond. Ø Shifting of sludge must be done on daily basis and each truck load weighment needs to be taken for each load- dumper without fail. Ø For preventive Maintenance or in case of any Breakdown of the equipment, replacement of the equipment to be provided by the vendor and vendor will inform to Corex team 24 Hrs. in advance. Ø Vendor must ensure all safety requirement during sludge loading and unloading and vehicle movement inside the sludge pond. Ø At loading point sludge ponds at Corex area loading excavator will be provided from Corex side. At disposal end sludge storage yard for unloading excavator will be under vendor scope. The Dozer at stacking yard is under Corex plant side. Ø Vendor must ensure continuous shifting of the dry sludge from sludge pond and ensure to keep always two sludge ponds in empty condition and not hampering of the continuous operations of Corex Plant. Ø Before opening of the sludge pond dams at Corex plant must take the clearance from Corex plant operations and vendor must ensure after cleaning of sludge ponds that all sludge pond dams are closed properly before giving clearance to readiness for filling and there not be any leakage from dam area afterwards. Ø Vendor must ensure the safety during sludge shifting and there should not be any spillage of the Sludge material on to the road. Ø Speed must be maintained with in the safety limit. In case of any violation of rules will leads to heavy penalty B. SAFETY The driver should wear the safety belt while driving the vehicles. 1. Your vehicle should have a reverse horn. 2. Your drivers shall maintain the vehicle speed limit as per company rules. 3. In case your persons are engaged in working in hot zone area, you should provide them with heat resistance suits - approved jeans jacket, cotton shirt, and cotton underwear <(>&<)> cotton socks, gum boots. 4. You shall deploy adequately trained and experienced personnel and equipment’s for ensuring smooth operation round the clock. 5. You shall engage the vehicles (with valid RTO documents) with drivers having a valid driving license. The driver and Cleaner should be deployed in such a manner to ensure availability of resources whenever required and each person employed does not have more than 12 hours working duration. 6. The tyres of vehicles should not be worn out. 8. The vehicle name plate, lighting systems including side blinkers shall be maintained without fail. 9. Equipment and manpower safety will be in vendor scope. 10. Operators need to maintain vehicle checklists throughout the month. 11. If any glass is found broken, it must be replaced immediately. 12. Vehicle safety should be maintained according to the specifications outlined in table No-1. 13. Vendor need to follow SOP <(>&<)> HIRAC during sludge shifting at the time of WO for understanding the specific job and accordingly you workforce to be trained. 14. Emergency Preparedness: • Emergency Response Training: Ensure all operators and drivers are trained in emergency response procedures, particularly for situations involving sludge or equipment failure. • First-Aid Kits and Emergency Equipment: Require that all vehicles and work sites have fully stocked first-aid kits and fire extinguishers. 15. Hazard Communication: • Signage and Barricading: Clearly mark and barricade areas where sludge loading and shifting occur, particularly in pond area. • Communication Devices: Equip all personnel with communication devices to ensure immediate contact in case of an emergency. 16. Load Securing: • Proper Securing of sludge: Ensure that sludge is securely loaded and covered during transportation to prevent spillage, particularly when transporting to export yards. • Regular Inspection: Implement a protocol for regular checks to ensure that the load is properly secured throughout the transport process. 17. Heat Stress Prevention: • Rest Breaks and Hydration: Ensure that workers operating in high-temperature environments, such as near hot water, have scheduled rest breaks and access to hydration to prevent heat stress. • Cooling Zones: If feasible, provide shaded or cooled areas where workers can take breaks to lower their body temperature. 18. Maintenance and Inspection Protocols: • Regular Equipment Maintenance: Include specific guidelines for the frequency and scope of maintenance checks on all vehicles and equipment, beyond just the monthly vehicle checklist. • Pre-Shift Inspections: Require pre-shift inspections of all equipment to ensure operational safety and to prevent breakdowns during sludge shifting operations. 19. Traffic Management: • Designated Routes: Establish designated routes for vehicles transporting sludge within the plant to minimize interactions with other plant operations and reduce the risk of accidents. • Traffic Controllers: Consider deploying traffic controllers or spotters in areas with high vehicle movement to ensure safe navigation and loading operations. 20. Behavioral Safety: • Safety Incentives and Penalties: Implement a system of incentives for maintaining safety standards and penalties for violations, encouraging a culture of safety among all personnel. • Fatigue Management: Beyond the 12-hour work limit, consider implementing a system to monitor signs of fatigue among drivers and op erators to prevent accidents. The movement of persons inside the plant by foot/bicycle/two wheelers is prohibited. Other Terms: Associate must undergo Medical Fitness at our Care Nursing Home, AM/NS Township, Hazira. This would be done as per AM/NS India standards and the cost shall be borne by the vendor. AMNS has its own Secures Access system called SCRUM at Hazira Site which is used for processing the Gate Pass. C. Statutory <(>&<)> General requirements: 1. Owner / Site in-charge compulsory attend monthly department contractor meeting. 2. Need to maintain attendance system for all manpower and supervisors as per company rules, more than 9 days duty not allowed. 3. No manpower allowed to duty more than 16 hours per day. 4. Regular inspection <(>&<)> vehicle checklist to be maintained by all equipment operators and submitted monthly. 5. All equipment’s need to available in fit and fine condition at corex site. 6. When billing, submit scrum report of operator for attendance verification. 7. The contractor shall provide the equipment and operators as per land of law (e.g., RTO Laws <(>&<)> Fitness) and company policies (e.g., Safety Certification <(>&<)> Competency Training). 8. All equipment must be following all applicable RTO, central, State, and local govt rules <(>&<)> regulations. 9. Vendor must ensure WSA Policy and Group Insurance for their manpower. 10. Vendor must have technical and operational competence to provide required services. 11. Vendor must have work experience in heavy industries such as large steel plant, cement, mining or port operations. 12. Vendor must comply with all relevant local, state regulations, including health and safety standards. 13. Vendor must have sufficient fleet to allocate sufficient resources, including manpower, equipment, to meet plant requirements. 14. Manpower Should be Competent as Per Competency Matrix as Per Latest MSA of AMNS. 15. Equipment manufacturing year must be 2018 or later (Equipment of manufacturing year before 2018 will not be allowed) and it should be in good working condition. Any decision regarding acceptance of equipment of YOM earlier than 2018 will be taken by AMNS only in exceptional cases. 16. Equipment should be ready to deploy / make operational at our site by 1st Jan 2025. However, the exact date of mobilization would be communicated 7 days in advance. Contract period from 1st Jan 2025 to 31st Dec 2025. 17. GPS system must be installed in all Tippers/dumpers from common vendor which is approved by AM/NS India. 19. All Equipment needs to be deployed from 07:00 am to 07:00 pm for Day Shift <(>&<)> 07:00 pm to 07:00 am for Night Shift. All equipment operators must be relieved on a one-to-one basis. 20. To avoid Production loss, equipment must be maintained in healthy condition for readiness for shutdown activities <(>&<)> regular work to complete in stipulated time. 21. Necessary attachment needs to be provided with equipment as per Operational Requirement as per Site Visit. 22. In case of Special attachment vendor to keep provision of various fittings <(>&<)> adaptors in advance for fitment in vehicle. Vehicle must be suitable for work at the AMNS site it has to be deployed. 23. The Contractor shall provide the specified equipment in healthy condition with skilled operators as per company policies. 24. The contractor shall deploy alternate equipment same specification or above in case of any breakdown above 48hrs duration. 25. Compliance with Labor Laws: • Registration under the Contract Labour (Regulation <(>&<)> Abolition) Act, 1970: Ensure that the vendor is registered under this Act, as it governs the employment of contract labor in certain establishments. • Payment of Wages Act, 1936 Compliance: The vendor must comply with the Payment of Wages Act, ensuring timely and complete payment to workers without unauthorized deductions. • Employees’ Provident Fund (EPF) and Miscellaneous Provisions Act, 1952: Ensure that all eligible workers are covered under EPF, and contributions are made regularly. 26. Compliance with Environmental Regulations: • Adherence to the Environmental Protection Act, 1986: The vendor must ensure compliance with all relevant environmental regulations, including waste management, air and water pollution controls. • Hazardous Waste Management: Specific compliance with the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016, should be enforced, particularly regarding the handling, transportation, and disposal of sludge and other industrial waste. 27. Health and Safety Regulations: • Factories Act, 1948 Compliance: The vendor must comply with all provisions under the Factories Act, including provisions related to worker safety, health, and welfare, especially in hazardous environments. • Mandatory Safety Audits: Periodic safety audits conducted by accredited agencies should be mandated to ensure ongoing compliance with safety standards. 28. Insurance and Liability: • Employees’ State Insurance Act, 1948: The vendor must ensure that all workers are covered under the ESI Act, providing medical and cash benefits in case of sickness, maternity, and employment injury. • Public Liability Insurance Act, 1991: Ensure that the vendor has adequate public liability insurance to cover any potential claims arising from accidents or environmental damage during operations. 29. Vehicle and Equipment Compliance: • Motor Vehicles Act, 1988 Compliance: All vehicles used by the vendor must adhere to the latest provisions of the Motor Vehicles Act, including insurance, fitness certification, pollution control, and registration requirements. • Periodic Vehicle Fitness Certification: In addition to regular inspections, it should be mandatory for all vehicles to undergo fitness certification by an authorized RTO, as per the Motor Vehicles Act. • Installation of Speed Governors: For heavy vehicles, ensure that speed governors are installed and maintained as per the Central Motor Vehicles Rules, 1989. 30. Periodic Compliance Reporting: • Monthly Compliance Reports: The vendor should submit a monthly compliance report covering adherence to all statutory and regulatory requirements, including labor laws, environmental regulations, and safety standards. • Third-Party Verification: Consider requiring third-party audits to verify compliance with statutory requirements, especially for e nvironmental and safety regulations. 32. Contractor Licensing: • Obtaining Necessary Licenses: The vendor must obtain all necessary licenses and permits required for the operation, including labor licenses, environmental clearances, and equipment operation permits. D. PENALTY Specific Penalty for nonperformance by vendor and must be cardinally measured. 1. A penalty will be imposed in case of noncompliance with HSE norms <(>&<)> Non-conformity of Work. 2. Violation of any safety norms will be penalized to the contractor. 3. Sleeping case of associates with penalty of minimum amount decided by PHSE if same case repeated the associates will be Suspended or terminated by Furnace in charges/Operation Head/HOD. 4. Misbehavior of Contractor associate with area Engineers/manager will be Penalized/ Suspended or terminated by Furnace in charges/Operation Head/HOD. 5. Violation of Company Traffic Rules will be penalized. 6. As per Management Directive, transport / movement of associates to <(>&<)> fro for Plant should be mandatorily in 4 Wheelers and Buses. Bicycles and Two wheelers are strictly not allowed. 7. Penalties for Statutory Non-Compliance: • Non-Compliance with Labor Laws: For any instance of non-compliance with labor laws (e.g., non-payment of wages, violation of working hour limits), a penalty equal to the number of unpaid wages plus a 50% surcharge will be imposed. Repeated offenses may lead to contract termination. • Failure to Comply with Provident Fund/ESI Regulations: If the vendor fails to make timely contributions to EPF or ESI, a penalty of 2% of the total contract value per incident will be imposed, and the company reserves the right to withhold payments until compliance is achieved. • Violation of Environmental Regulations: Any breach of environmental regulations, such as improper disposal of sludge or failure to comply with pollution control norms, will result in a penalty of INR 1,00,000 per incident, with repeated violations leading to contract termination. 8. Penalties for Vehicle and Equipment Non-Compliance: • Non-Compliance with RTO and Motor Vehicle Laws: If any vehicle is found operating without valid RTO documentation, fitness certification, or pollution control certificate, a penalty of INR 50,000 per vehicle will be imposed. Additionally, the vendor must rectify the issue within 24 hours, failing which further penalties will be applied. • Failure to Maintain Equipment Standards: If equipment is found to be non-compliant with safety standards or in poor condition, a penalty of INR 20,000 per piece of equipment will be imposed, and the equipment must be replaced within 48 hours to avoid further penalties. 9. Penalties for Safety Non-Compliance: • Lack of PPE or Safety Equipment: If workers are found without proper PPE or safety equipment, a penalty of INR 10,000 per incident will be imposed. Penalties for Inadequate Training and Competence: • Untrained or Incompetent Personnel: If any worker is found to lack the necessary training or competence as per the Competency Matrix, a penalty of INR 5,000 per worker per day will be imposed until the issue is rectified. This also applies if operators are found without valid certification or training. • Failure to Maintain Attendance and Work Hours: If the vendor fails to adhere to the attendance system or work hour limits, a penalty of INR 10 ,000 per worker per incident will be imposed, with the potential for further penalties if noncompliance continues. 11. Penalties for Reporting and Documentation Failures: • Failure to Submit Required Documentation: A penalty of INR 5,000 per day will be imposed for each day that required statutory, safety, or operational documentation (e.g., vehicle checklists, compliance reports) is delayed or incomplete. • False or Misleading Documentation: If the vendor is found to have submitted false or misleading documentation, a penalty of INR 50,000 will be imposed per incident, with possible legal action and contract termination for severe cases.
