Bids Are Invited For Custom Bid for Services - Assistance in scheduled major Repair Maintenance Of Heme Lmv Equipments - 2. Scope of work :-Details are given belowa) Assistance in Pre planning repair and maintenance of HEME and LMV Equipment’s which include( Hydraulic Excavator, ICM,IDM, Power Shovel, pontoon pump & pontoon house ,Motor Grader ,Water Tanker(sprinkler),Dumper ,Dozer, bolero, jeep, ambulance etc). b) Assistance in capital and major maintenance of HEME Equipment’s which include repair of Hydraulic excavator bucket, track chain maintenance, fixing of bottom roller, body frame welding, engine repair, engine replacement, PTO repairing, PTO changing, Hydraulic main pump changing, Hydraulic cylinder repairing and changing, Boom changing, track frame changing, new equipment assembling etc. c) Assistance in capital and major maintenance of HEME Equipment’s which include repair of drill machine ICM engine repairing and changing, Under carriage repairing ,IDM under carriage repairing, air end assembly changing ,bogie repairing etc. d) Assistance in capital and major maintenance of HEME Equipment’s which include repair of dumper dump body changing, engine changing, transmission changing, hinge pin changing, final drive seal changing, suspension changing, dump body repairing , brake repairing etc e) Assistance in capital and major maintenance of HEME Equipment’s which include repair of Dozer engine changing, track roller changing, under carriage repairing, final drive repairing , blade changing , all type of cylinders changing, etc. f) Assistance in building/revamping/modification of -Pontoon pump& house and its related jobs. g) Assistance in assembly works which include dismantling and assembling of pontoon pump, boom / bucket / arm cylinder repairing ,dumper hoist cylinder repairing, front and rear suspension repairing, water sprinkler front and rear suspension, dozer lifting and tilting cylinder.etc i) Minimum 05 (Five) workers i. e. two welder (semi skilled) and three unskilled workers are required for these jobs. 3.0 COMMON :- 3.1Instruction to bidder (herein after referred as ITB) shall also be applicable in addition to the General Conditions of Contract- Steel Authority of India Limited Bhilai Steel Plant (herein after referred as GCC). 3.2 Wherever SCC differs from ITB/GCC, SCC shall over-ride ITB/GCC. Wherever ITB differ from GCC, ITBshall over-ride the GCC. 3.3 Wherever the description of the work in Tender Schedule differs from the general specifications, the description given in the Tender Schedule shall override the later. 3.4 Copy of GCC is available in the SAIL Website https://sailtenders.co.in and in the Contract Cell- Non Works; interested bidder can read it, clarify their doubts from the office of tender issuing officer. The Bidder does not need to submit copy of GCC along with the Tender. However, the Bidder by submitting the tender shall be deemed to have read and understood these conditions and the same shall, for all intents and purpose, be deemed to be forming integral part of the contract and shall always beconstrued accordingly. 3.5 Contractor shall register all his workers in A-form available at time office Nandini Mine. The registration shall be done only for those workers who have undergone workmens training at MVTC Nandini for the period required as per Mines Act. 3.6 In the event of any impersonation committed by any of the contracts workmen or if upon any enquiry any of his workmen is found engaged in any work and such work is detected to be not the real workmen in whose name the gate pass or any other pass was applied for by the contractor and issued by the CISF on the recommendation of the company (ie. SAIL, BSP) the contractor shall bear full responsibility in this regard, and the contract, at the discretion of the company, shall be liable for termination at the risk and cost of the contractor. 3.7 In case the party, his partner member servant labour agent, representative and/ or person working for and on all behalf of the party is found involved in any unauthorized or wrongful removal of materials or in any attempt for such removal, this shall amount to breach of contract caused by the party and the company shall be entitled to forfeit the entire security deposit and any other amount, money or material that may be lying with the company at the risk and cost of party. The party shall be further liable for all the losses that might be caused to the company on account of such unauthorized/ wrongful removal. In such an event, the company can ban business dealings with such party. Decision of companys management will be final and binding on the party in such cases. 3.8 The rates quoted during the contract period shall be firm and no escalation shall be provided except PVC clause. 3.9 If the quoted rates is less than the lower limit of the estimated price and is considered for placement of order, the bidder may be asked to justify the rate quoted. 3.10 The Contractor while engaging his workmen, would give preference to those individuals who either have Aadhar Card /applied for Aadhar Card/agreed to apply for Aadhar Card and pay to such workmen through Aadhar Payment Bridge to the extent possible 4.0 DURATION OF CONTRACT 4.1 The work should be Executed within (02) Two Year from the date of commencement of the contract. 4.2 The contractor will be permitted a maximum 15 days preparation time to make arrangements for labour, tools, safety appliances etc. so as to take up the work in right earnest. This 15 days’ time is excluded in the total time for execution of the work. 4.3 No claim will be entertained in case the work is stopped, after starting due to operational priorities/ shut down/ breakdowns. In this regards the decision of the operating authority will be final and binding. 5.0 WORKING HOURS: 5.1 The contractor will be allowed to work in all shifts (A,B,&G) in case of exigency the worker will be called for C shift, As per the work allotted by Executing authority. 5.2 In case the work necessitates worker may call for execution of job on w/off or holidays in any shift. The operating authority shall suitably communicate through instructions given in the Log Book and/ or by a letter sufficiently in advance. The contractor shall make such necessary arrangement for the work and obtain requisite permission for taking up work in such exigencies. 5.3 The contractor from 6 pm to 6 am shall employee no female worker. 6.0 SAFETY: As Enclosed New Safety Annexure. 7.0 LIQUIDATED DAMAGES: 7.1 Liquidated damages shall be levied against the contractor in case of delay in execution of contract beyond the date of completion of job specified in contract. For the portion of delay which is attributable to SAIL/ force majeure or to the contractor, the case shall be dealt with as follows: I) Delay attributable to SAIL / Force majeure: LD Not Applicable. II) If delay is attributable to the contractor: LD shall be levied @ 0.5 % of basic unexecuted value perweek of delay beyond the stipulated date of completion. 7.2 If any labour not present in duty as per clause 2.(i) of scope of work, penalty will be imposed & deducted from partys bills in following manner:- i. for absent of un-skilled labour penalty will be deducted Rs.1125.28 per man per day of per day of awarded rate +PVC for item No. 1 ii. for absent of semi-skilled labour penalty will be deducted Rs. 1327.61 per man per day of per day awarded rate +PVC for item No. 1 iii. Total Penalty & LD shall not exceed 10% of Contract Value. 8.0 MATERIAL: 8.1. To be issued by BSP: welding electrode and gas cylinder.(as per nature of job). 8.2 To be supplied by the contractor: welding sets( which includes screen, holder),cutting sets,key, welding hand gloves ,safety goggles etc and other related safety devices. 9.0 RISK AND COST CLAUSE: If the Operating Authority shall certify in writing to the employer that in his opinion the Contractor. (a) has abandoned the contract, or (b) has failed to commence the work without reasonable excuse or has suspended the progress of the work for 28 days after receiving written notice to proceed from the Operating Authority. (c) is not executing the work in accordance with the Contract or is persistently or flagrantly neglecting to carry out his obligations under the Contract, or (d) has to the detriment of good workmanship or in defiance of the Operating Authority’s instructions to the contrary sub-let any part of the Contract, or (e) Otherwise failed to perform his part of the contract according to the true intent and meaning thereof, then the employer may terminate the contract without prejudice to rights and call upon the contractor to vacate the site by giving 7 days’ notice. If the contractor does not vacate the site within the period stipulated in such notice, the employer shall be at liberty to expel the contractor from the site in such manner as may be found or considered expedient in the interest of early completion of work. The contractor shall not be released from any of his obligations or liabilities under the contract nor shall the rights and powers conferred on the employer or the engineer by the contract or otherwise available under law get impaired, abridged or diminished in any manner Whatsoever. The employer may himself complete the work left over by the contractor or may employ alternative agency to complete the work at the risk and cost of the contractor. The employer or such alternative agency may use for such completion so much of the constructional Plants, temporary works and materials which have been deemed to become the property of the employer under the provisions of the contract as he or it may think proper and the employer may at any time sell any of the said constructional plant, temporary work and unused materials and apply the proceeds of sale in or towards the satisfaction of any sums due or which may become due to him from the contractor under the contract and in the completion of work as above. 10.0 AUTHORITIES:- 10.1 Executing authority:- AGM (Mech), NM 10.2. Operating authority:- DGM (Mech.& TA), NM 10.3. Inspecting authority:- .G.M cum Agent (Nandini Mines) 11.0 MODE OF MEASUREMENT/ INSPECTION:- 11.1Mode of measurement will be in Days, Unit: Day. This will be done by counting the number of labour deployed/day for 8 hour shift. 11.2 Attendance record will be recorded per day by the Executing authority or his representatives. 11.3 Operating Authority will be the final authority for certify the Attendance. 12.0. GUARANTEE/ MAINTENANCE: 12.1. As the work is consisting of the assistance in repair & maintenance work, hence no maintenance period is required. 13. DEDUCTIONS/ DEPOSITS/ REIMBURSEMENT: 13.1 Only Bid security declaration in lieu of EMD to be submitted by contractor. No Earnest Money (EMD) shall be required to be deposited by the bidder. However, if any tenderer defaults in submitting responsible offer against LTE a) He shall be disqualified for participating against future tender enquiries for a period of one year. b) For more than one attempt, action for de registration / banning shall be taken against the tenderer as per the procedure for initiation of banning action. 13.2 S.D. shall be recovered from the running/final bills of the contractor @ 3% of each bill value (exclusive of GST/Penalty, if any). 13.3 TAXES & DUTIES CLAUSE – As per New Annexure -TD 14.0 MODE OF PAYMENT: 14.1. The contractor shall be paid RA bill commensurate with the progress of the work subjected to useful deduction of S.D and other deductions as per practice in vogue and guidelines issued by competent authority from time to time. 14.2. The employer shall have right to withhold, retain and set off all sums due or to become due to the contractor (including Security Deposit & Earnest Money) whether under this contract or under any other transaction or claim whatsoever, against any sum due or become due to the employer under this contract or under any other transaction or claim whatsoever, may be appropriated towards the due of the government. 14.3. Payment schedule shall be as under: a) Within 30 Days after receipt of each running account bill along with the requisite documents. b) Within 60 days for payment of final bill, after completion of all the tests and other formalities as per the terms and conditions of the contract. 15.0 COMPLETION OF WORK: 15.1. As soon as, in the opinion of the engineer the work shall have been completed and shall have satisfactorily passed, the engineer shall on receiving written request from the contractor issue a certificate of completion in respect of the work(s). 15.2. After the completion of work, the site shall be cleared of all rubbish, surplus earth shall be dressed within the area bounded by the fencing or the compound wall or 15 M all round whichever is maximum. Cost of such dressing shall be deemed to be covered by the quoted rates. The work will be deemed to be completed only when such clearance and dressing completed. 15.3. In the event of contractors acceptance of the final bill in full and final settlement of the contract, the contract would be deemed to have come to an end. The contractor shall be stopped from rising any dispute whatsoever in respect of the said contract after given certificate. 15.4. The party has to submit closure report along with indemnify bond within 15 days after completion of work. 16.0 OTHER CLAUSES/ LAWS/ RULES:- The contractor shall be aware of arbitration clauses, obligations of contractors, Force major clause etc. If required he is advised to go through these which are available at Contract Cell, IOC Rajhara. 17.0 CLOSURE/ TERMINATION OF CONTRACT CLAUSE: 17.1 The company reserves the right to terminate the contract by giving 7 (seven) days’ notice on the account of any of the following reasons:- Failure of the contractor to commence the work within the period stipulated in the award letter/letter of intent. Failure of the contractor to re-start the work stopped by him except the case of Force Major Clause within a period of 3 days from the date of stoppage or after receipt of the notice from the Company directing the contractor to re-start the work. This will however, not necessarily absolve the contractor of Liquidated damages. If the performance of the contractor is found to be unsatisfactory or if he fails to give the desired progress of the work or quality thereof. 17.2 Non- performance in whole or in part by the contractor, of any obligation under this contract due to reasons within his control shall be treated as breach of the contract, entitling the company to terminate the contract and to recover from the contractor the cost of damages sustained by the company for such default by the contractor and due to termination of contract. 17.3 If at any time during tenure of this contract the performance in whole/ or part of any obligation under this contract is prevented or delayed by reasons not under the control of contractor such as war, hostilities (whether war declared or not) invasions by foreign enemies, rebellions, revolution, insurgence or military or any such operation or due to the force of nature as reasonable foresight and ability of the part contractor could not foresee or reasonable against (all of which are herein collectively referred to as the excepted risk) the contractor shall not merely by reasons of such eventuality be entitled to terminate his contract. The company shall not have any damage to the contractor in respect of such non-performance or stoppage, provided notice of such happenings is given by the contractor to the company within 48 hours from the date of such occurrence. 17.4 The contractor shall resume the work as soon as practicable after such eventuality has ceased to exist and the company shall be sole judge to decide whether or not the eventuality existed, provided if the performance in whole or part of any obligations under this contract is prevented or delayed by reasons of any such eventuality for a period exceeding 07 days the contract may be terminated by the company at its discretion. 17.5 Contractor shall give an undertaking NDC in Stamp Paper that he will not have any further claim from Bhilai Steel Plant after the payment of Final Bill. In the event of acceptance by the contractor of the final bill in full and final settlement of contract, the contract shall be deemed to have come to an end and there after the contractor shall be stopped from raising any dispute whatsoever of the said contract. Submission of conditional acceptance/undertaking by the contractor shall render the final bill (along with other dues) pending for which the contractor shall be solely responsible. 18.0 REFUND OF SD ON COMPLETION OF WORK: 18.1 The security Deposit (SD) shall be refunded to the contractor after completion of the maintenance period, subject to production of certificate from the operating Authority to the effect that the contractor has disbursed all labour payments and other statutory payments and nothing is outstanding against him. 18.2 Any amount due and payable to the contractor including Security Deposit, can be SETOFF against any claim of the company arising out of this contract or any other contract made between the company and the contractor or any claim of the Government or any person or persons legally approaching through the government. 18.3 In case of any loss or damages to the goods, property or assets of the company on account of any activity of the contractor, the company shall be at a liberty to recover the loss or damages so incurred from any sum of money due and payable to the contractor including SD. 18.4 The company will not reimburse to the contractor any expenditure or cost incurred on account of discharge of any labour due and in case of any legal payments, the same shall be discharged by the company against any amount of the contractor available with the company including SD. 19.0 LABOUR LAWS:- AS per annexure LC 20.0 ROYALTY CLEARANCE: NA. 21.0 ADDITIONAL WELFARE AMENITY: The contractor shall pay additional welfare amenity @ 142.31 per day of actual attendance for the contractors labour engaged by him against the contract. The rates quoted shall be inclusive of the implication involved due to payment of this additional welfare amenity also and no extra payment shall be made to the contractor in this account. 22.0 BANING OF BUSINESS DEALING CLAUSE 22.1 The company reserves its rights to remove from the list of approved supplier / contractors or to ban business dealings, if any Agency has been found to have committed misconduct, and also to suspend business dealings pending investigation. The procedure under which removal of an agency from the list of approved suppliers/contractors or suspension or banning of business dealings will be dealt may be referred on our website as a part of the tender documents. 23.0 EMPLOYEMENT OF PERSONS: 23.1 The contractor shall depute his workmen at his own cost to MVT Center, Nandini to undergo initial & refresher training under MVT rules & shall pay wages and allowances to them for the number of days they undergo training. However the company shall not charge any cost towards imparting of training at M.V.T. Center, Nandini 23.2 The contractor shall not engage any workmen in the Mines without having them registered in the Form B kept in the office of the Mines. 24.0 RETURN OF GATE PASS:- All the gate passes issued to the contract labours have to be deposited back with CISF within of days from date of completion of contract and delay in returning of gate pass invite penalty @ Rs 2/-day/pass. In case loss of gate pass enhanced from Rs 5/- per gate pass to Rs 50/- per gate pass. 25.0 QUALITY OF WORK: - The quality of the work shall be as per work schedule. 26.0 SAFETY CONDITIONS – As per annexure SC& SC-A 27.0 PVC Clause for labour Wages The contract rate shall not be subjected to any variation except for labour. however the same will be applied on account of increase or decrease in the applicable rate of Minimum Wages as per Minimum Wages Act notified by the Govt. of India. The rate calculation will be done as per the following formula - VL = CL/100 X RB X (W-WB)/WB Where VL= Amount of adjustment in the rate for activities under different iteme of work. RB = Contract rate as on base date for activities under different item of work. Base date will be the date of tender opening/RA W = Revised prevailing wage rate(as per Minimum Wages Act as notified by the Govt.) WB = Wage rate (as per Minimum Wages Act as notified by the Govt.) CL = Labour component (70.41%). 27.1Base date for calculation of escalation / de-escalation on account of Labour wages shall be last date of submission of tender including extended date of submission of tender. However, incase tender submission date is extended, the Base Date for Labour wages escalation/ de- escalation shall be the final extended date of submission of tender. In case if Price is discovered through Reverse Auction, base date for calculation of escalation / de-escalation shall be the date of RA. 27.2 PVC IN CASE OF EXTENSION OF PERIOD OF CONTRACT: If the original awarded quantity is not executed within the scheduled period of contract, then the balance quantity has to be executed during the extended period. For the portion of delay which is attributable to SAIL / force majeure or to the contractor, the case shall be dealt with as follows: I) Delay attributable to SAIL / Force majeure: Price Variation for Wages as detailed above shall be applicable during such extended period. II) Delay is attributable to contractor: For work executed during the extended delivery period, the rates as prevailing on the last day of the scheduled contract period only may be paid. De-escalations/reductions, if any, which takes place, during the extended period the same shall have to be passed on to SAIL, BSP 28.MINES ALLOWANCE: The workers are eligible for payment of Mines Allowances at the rate of Rs. 100.00 / workday / workmen. The rates quoted shall be inclusive of the implication involved due to payment against Mines Allowances and no extra payment shall be made to the Contractor in this account. 29. NIGHT SHIFT ALLOWANCE : The workers are eligible for payment of Night shift Allowances at the rate of Rs. 90.00 / Night shift / workmen. The rates quoted shall be inclusive of the implication involved due to payment against Night Allowances and no extra payment shall be made to the Contractor in this account. 30. EL ENCASHMENT: The workers are eligible for EL as per rules ie 5%of wag(BASIC+VDA) and the rates quoted shall be inclusive of the implication involved due to payment against Earned Leave (EL), and no extra payment shall be made to the Contractor in this account. 31.OPD MEDICAL FACILITY TO CONTRACT WORKER WORKING IN MINES This clause shall be applicable for contracts where the original contract duration is for more than 6 Month. The successful bidders / tenderers shall have to enter in to a MOU with any one of the following hospitals mentioned against respective Mines for treatment methodology, billing, claims and reimbursement etc. IOC Dalli Rajhara-1.Shaheed Hospital 2.Jyoti Hospital Nandini Mines-Nandini Nursing Home, Ahiwara Hirri Mines-AarBee Hospital, Bilaspur The list of hospital may be revised in due course of time & shall be binding on the contractors. All the contract workers (Including township, hospital etc.) engaged in the work and their eligible dependents (Whose names appearing in Ration Card issued by state govt.) shall be provided OPD medical facility through the successful bidder/tenderer in any of the designated/empaneled hospitals of respective Mines . From every bill, an amount equivalent to 3.25% of wages (Basic+VDA) (To be calculated from wages cum muster roll) shall be apportioned/ deducted and a corpus shall be maintained for OPD medical expenses. No further deduction shall be made from contractors for providing medical facility through this MOU. Up on submission of bid it shall be considered deemed acceptance by the bidder/tenderer towards agreement for entering in to MoU in this regard. Total Quantity :
