The Excavator <(>&<)> Hywa supplied on hire day basis shall be: (a) JCB 210 or JCB 280 2. The requirement is to supply 1 No’s of JCB 210 or JCB 280 with Registration after 2018. The EXCAVATOR also be required to excavation <(>&<)> load the material to the Hywa from loading point. 3. HSD will be claimed on hour basis, 15 Ltr/hr 2.0 Operating Conditions: 1. Contractor to ensure the adequate availability of fuel (Diesel) during daily service of Vehicles. 2. Contractor shall provide copy of registration certificate of Vehicles in his name, insurance certificate, Permit etc. within month of purchase of vehicle. The copies of driving licenses of drivers shall be submitted immediately. 3. The drivers will be given half an hour break for lunch. Contractor shall arrange for driver’s lunch and dinner, if any along with his accommodation. 4. The contractor shall depute a supervisor / representative who shall take instructions and report to the officer in charge. He shall co-ordinate movements of vehicle accordingly on day-to-day basis and ensures the following. a) Vehicle reports on time. b) Vehicle reports with sufficient fuel. c) Vehicle to report with extra tyre, tool kit, etc. 5. In case of breakdown or repairing, the contractor shall arrange for alternate Vehicles within two hours. 6. Safety and punctuality is the essence of the contract and the same at no time is in jeopardy due to mal operation, negligent driving, vehicle breakdown etc. 7. The drivers on duty shall have a valid Transport license and they should bear good etiquette. Drivers shall have good knowledge of attending to mechanical failures to overcome problems of Vehicles. 8. HSD will be in vendor scope excluding the hiring price of Hywa. 3.0 Contract period: 1. The contract shall be valid for a limited period of 7 days. 2. If the quantity of vehicles will get further increase during the contract period, then contractor will provide the vehicles on the same rate, terms <(>&<)> conditions as per contract. 4.0 Maintenance of Vehicles: 1. During time of maintenance and repair of Vehicles, alternative vehicle of same capacity should be provided by the contractor at no extra cost 5.0 DAMAGE TO PROPERTY: Contractor shall be responsible for making good to the satisfaction of the Owner any loss of and any damage to all structures and properties belonging to the Owner or being executed or procured by the Owner or of other agencies within the premises of the work of the Owner, if such loss or damage is due to fault and/or the negligence or wilful acts or omission of the Contractor, his employees, agents, representatives or sub-contractors. The Contractors shall indemnify and keep the Owner harmless of all claims for damage to Owners property arising under or by reason of this contract. 6.0 Arbitration: If any difference or dispute shall arise between the Seller and the Buyer as to the construction or intent or meaning of the terms and conditions herein contained or any payment to be made in pursuance hereof or as to any other matter arising out of or connected with incidental to these presents or the rights or duties of either party, such difference or dispute shall be referred to arbitration of a Sole Arbitrator who shall be appointed by Chief Operating Officer of the Buyer. The arbitration shall be held at a place determined by the Arbitral Tribunal. The Arbitral Tribunal shall conduct arbitration proceedings in accordance with the Arbitration and Conciliation Act, 1996 or any statutory amendments thereof. 7.0 Jurisdiction: Courts at Keonjhar alone shall have jurisdiction arising out of this contract. 8.0 Mobilization Period: Contractor to mobilize their resources immediately/ within 2 days from order. 9.0 Billing / Payment Terms: 1. The contractor shall submit the bill along with original log sheets, signed by AM/NS officers, to Officer-in-charge on daily basis. The start Kms for the vehicles shall be the 1st start / pickup point of the user and the end Kms will be the last dropping point of the user as per the instructions of officer-In-Charge. Payment shall be made on VTS system reading or Logbook (Whichever is lesser) as per directions of EIC. 2. The bills shall be submitted at the day of work completion. 3. Payments shall be made through e-payment or account payee cheque payable at par within 30 days from the date of receipt of certified bill at disbursement office at Dabuna 10.0 Other Conditions: 1. Vehicles shall be inspected by Officer in-charge, prior to acceptance of supply and in case of rejection contractor shall arrange for alternate vehicle of same specifications as per above mentioned clauses. 2. The working hours and starting kilometres, for the day shall commence from the time and place of reporting of the vehicle, as advised by the Officer-in-charge and will end at the time and place of release of vehicle. The contractor shall also ensure payment to drivers, helpers for duty beyond normal duty hours on monthly basis as per terms and conditions of contract and submit the copy of payment to AM/NS. 4. The vehicle shall be covered by Motor Vehicles act and contractor shall be liable to pay for any breach of said provisions. All documents and licenses as per this act shall be always available during operation of vehicle. Also, the contractor shall submit the copies of registration of vehicle, driving license/s of driver’s insurances, permit etc to AM/NS. 5. Contractor shall pay all taxes, duties payable under Motor Vehicles Act or any such fees charged chargeable under the above act or by any order from time to time. 6. Contractor to ensure the availability of papers required for Interstate Permit, Registration paper, Insurance, PUC, Road taxes etc. complete, kept in original with vehicles. 7. While the vehicles are at service with AM/NS, all taxes, fines if any imposed by authorities shall be paid by contractor, AM/NS shall not be responsible for any such event. 08. In case the driver/s or any other person/s employed directly or indirectly by the contractor for this order shall not be considered employees of AM/NS, this contract is only for hiring vehicles. 9. The rates mentioned in Annexure-I shall include all expenses including wages to the driver/s, fuel cost, all insurance charges, m aintenance of vehicles, Toll Tax, Parking and any other state Permit, statutory fees etc except Service tax which will be paid extra on actual. 10. Parking of vehicle, toll charges, other state entry tax etc will be paid by Vendor. 11. All statutory contribution towards PF, ESI, WC, Overtime etc. for the drivers shall be made by the contractor.
