3 It Should Be Included In The Unit Prices Of Delivered Products And Should Not Be A Separate Item On The Invoice/Account. The Contractor Must Provide All Devices And Elements That Are Necessary For The Proper Functioning Of The Whole. In The Event That During The Implementation Of The Subject Of The Contract It Turns Out That There Is A Lack Of Any Device, An Element Whose Lack Will Result In The Incorrect Functioning Of The Entire Subject Of The Contract, The Contractor Will Provide It At His Own Expense. A Detailed Description Of The Subject Of The Contract In Scope Of Task No. 1.2 Is Described In Annex 3 To Swz, Except That The Employer Allows Equivalent Solutions Described In The Above -Mentioned Documentation. In The Case Of Use In The Documentation Describing The Subject Of The Order Of References To The Standards, European Technical Assessments, Approval, Technical Specifications And Technical Reference Systems, The Contracting Authority Allows Equivalent Solutions. When Analyzing The Documentation, The Contractor Should Assume That Each Reference Used In The Documentation Is Accompanied By A Or Equivalent Word. In The Event That Trademarks, Patents Or The Origin Of Products/Source/Special Process That Could Characterize Products Or Services Provided By A Specific Contractor, Means That They Are Given, For Example And Define Only The Minimum Expected Quality Parameters And The Required Standard, It Means In The Documentation. The Contractor May Apply Equivalent Materials Or Devices, But With Technical And Quality Parameters Similar Or Better, Which Will In No Way Negatively Affect The Proper Functioning Of The Solutions Adopted In The Documentation. The Contractor Who Uses Devices Or Equivalent Will Be Obliged To Show During The Performance Of The Order That The Devices And Materials He Used Meet The Requirements Set By The Employer. Pursuant To Art. 101 Para. 4 Of The Public Procurement Law Act, The Contractor Using Equivalent Materials Undertakes To Use Materials With Parameters Not Worse Than Those Specified In The Documentation. If The Employer Allows Equivalent Solutions Described In The Documentation, But Does Not Provide Minimum Parameters That This Equivalence Confirmed The Contractor Is Obliged To Offer A Product With Similar Properties, Which Is Functionally Suited To The Required Use. The Employer Cannot Reject The Offer Just Because The Construction Works Offered, Deliveries Are Not In Line With The Standards, Technical Assessments, Technical Specifications And Technical Reference Systems, To Which The Description Of The Subject Of The Contract Applies, Provided That The Contractor Proves In The Offer That The Proposed Solutions Conclude The Requirements Specified In The Description Of The Subject Of The Contract. The Contractor, Who Refers To Equivalent Solutions, Is Obliged To Show That The Solution He Offers Meets The Requirements Set By The Contracting Authority.
