The Purchaser Provides For The Possibility Of Annulment Of The Contract Award Procedure Pursuant To Art. 257 Of The Pzp Act, If The Public Funds That The Contracting Authority Intended To Allocate To Finance All Or Part Of The Contract Will Not Be Granted To Him. 3. The Ordering Party Does Not Divide The Order Into Parts Due To The Fact That Such A Division Would Threaten Excessive Technical Difficulties And Excessive Costs Of Performing The Contract. Failure To Divide The Order Was Therefore Dictated By Technical And Organizational Reasons And The Nature Of The Subject Of The Contract. 4. The Contractor Is Obliged To Demonstrate That The Offered Deliveries Meet The Requirements Of The Employer. 5. All Products From Specific Manufacturers Specify The Minimum Quality Parameters And The Utility Features That The Products Must Meet To Meet The Requirements Set By The Ordering Party And Are Only A Qualitative Model Of The Subject Of The Contract. 6. By A Provision Regarding The Minimum Requirements Of Quality Parameters, The Contracting Authority Understands The Requirements Of Goods Contained In Generally Available Sources, Catalogs, And Manufacturers Websites. Operating Examples Of The Manufacturers Names Is Only Aimed At Clarifying The Level Of Expectations Of The Employer In Relation To A Specific Solution. Thus, Using The Names Of Producers Or Products Is Only An Exemplary Nature. The Contracting Authority, When Describing The Subject Of The Contract, Indicating The Designation Of A Specific Manufacturer (Supplier) Or A Specific Product, At The Same Time Allows Equivalent Products With Quality Parameters And Utility Features, At Least At The Level Of Parameters Of The Indicated Product, Thus Recognizing Each Product With Indicated Parameters Or Better. In Such A Situation, The Employer Requires The Submission Of Relevant Documents That Make These Materials Or Devices Specify. 7. For Specified Devices, The Given Parameters Are Minimal Values, Any Equipment With Better Parameters, Higher Than Specified Meets The Requirements Set By The Contracting Authority. All Devices Should Meet All Provisions Regarding The Right Of Admission To Use In Poland And Have Relevant Documents Indicating That All Necessary Standards And Guidelines That Should Be Met By The Above Equipment Before Being Allowed To Use. 7
