1. The Subject Of The Contract Is Delivery Based On An Operational Lease Agreement For A Factory New Construction Machine, I.E. A Backhoe Loader, Hereinafter Also Called Machine Or Subject Of Lease. 2. Leasing Conditions: 1) Operational Leasing. 2) Currency- Pln. 3) The Interest Rate. 4) Leasing Period- 60 Months. 5) Leasing Fees: A) Initial Leasing Fee Of 20% Of The Initial Value Of The Leasing Subject, B) 59 Equal Monthly Leasing Installments, C) Fee For Purchasing The Subject Of The Lease- 1% Of The Initial Value Of The Leasing Subject. 6) If The Provisions Of The Public Procurement Agreement And This Description Of The Subject Of The Contract Are Too General And It Is Necessary To Conclude A Separate Lease Agreement, The Contracting Authority Agrees To The Conclusion Of Such A Contract On The Standard Template Used By The Contractor, With The Proviso That The Provisions Of Such A Contract Cannot Be Contrary To Swz And The Public Procurement Contract (In The Event Of Contradiction, The Provisions Of The Contract No. Tp/Ti/3/2025 With Attachments). 3. Delivery Conditions Of The Subject Of The Lease: 1) The Contractor Shall Provide The Employer With A Backhoe Loader To The Department Of Engineering And Renovation Located At Ul. Nowodworska 60 In Legnica (59-220). The Machine Supplied To The Ordering Party Should Be Technically Efficient. 2) On The Day Of Delivery Or Within The Date Agreed By The Parties, The Contractor Should Provide The Employer With The Relevant Documentation (Original Or Copy) Regarding A Backhoe Loader: A) Technical Documentation In Polish For A Complete Machine, B) User Manual In Polish For A Complete Machine, C) A Guarantee And Service Book In Polish. The Contractor Is Obliged To Provide In The Warranty And Service Book, In Particular: Names, Brands, Type, Parameters And Manufacturer Of The Offered Machine As Well As The Name And Seat Of The Service Authorized By The Producer Backhoe Loader, As Well As Information Needed To Exercise Rights Under The Warranty Referred To In Art. 577A §2 Of The Civil Code, D) Declaration Of Compliance With Ce Certificate In Polish For The Backhoe Loader Offered, E) A Catalog Of Spare Parts. 4. Characteristics Of The Subject Of The Leasing Constituting The Subject Of The Contract. 1) The Construction Machine Should Be Brand New (Year Of Production: 2025); 2) Backhoe Loader Should Meet The Requirements Of The Machine Allowed To Move On Public Roads In Accordance With Applicable Provisions Of The Act Of 20.06.1997- Road Traffic Law; 3) Engine: A) An Internal Combustion Engine, Row, Turbocharged Diesel With A Charge Air Cooler, B) Number Of Cylinders: Min. 4, C) Maximum Power: Min. 109Km (Min. 485Nm), D) Factory Lock Of The Torque Substitute Reducing Fuel Consumption, E) The Norm Of Emissions: In Accordance With The Requirements Of The Law In Force At The Date Of Delivery And Enabling The Allowance Of The Machine To Move On Public Roads; 4) Charger Arm: A) Maximum Loading Height: Min. 3.1 M, B)
