The Contractor Ensures That The Supplied Software:- Comes From A Legal Source And Has All The Components Confirming The Legality Of Their Origin (E.G. Original Packaging, Original Media, License Agreement, Access Key, Etc.),- Does Not Violate The Act On Copyright And Related Rights (I.E. Journal Of Laws Of 2025, Item 24, As Amended)- Comes From Official Sales And Distribution Channels Manufacturer To The Polish Market. 2. Equivalent Solutions2.1. If The Employer In The Description Of The Subject Of The Contract Indicated Trademarks, Patents Or Origin, Sources Or A Special Process That Characterizes The Products Or Services Provided By A Specific Contractor, It Is Allowed To Offer Equivalent Solutions Described, Provided That They Maintain The Same Minimum Technical, Qualitative And Functional Parameters, Etc.2.2. The Contractor, Who Refers To Equivalent Solutions, Is Obliged To Show That The Solution He Offers Meets The Requirements Set By The Contracting Authority. In This Case, The Contractor Attach To The Offer A List Of Equivalent Solutions Along With Its Description Or Standards. 2.3. In The Event That The Description Of The Subject Of The Contract Includes References To Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Para. 1 Point 2) And Para. 3 Of The Pzp Act, The Contracting Authority Allows Equivalent Solutions Described.
