The Subject Of The Contract Is The Performance Of The Task Entitled: Delivery And Assembly Of Interior Design Of The Toddler Club In Andrychów As Part Of The Task: Creation Of 50 New Childrens Care Places Up To 3 Years In The New Institution Of The Childrens Club At: Ul. Metalowców 6 In Andrychów - Part I - Furniture And Permanent Equipment; 5.2 The Scope Of The Subject Of The Contract In A Given Part Includes In Particular: 5.2.1 Supply Of Equipment To The Address Of The Childrens Club: Ul. Metalowców 6, 34 - 120 Andrychów 5.2.2 Installation And Equipment Setting In Accordance With The Interior Design Design And Product Specification 5.2.3 Starting With Checking The Correct Operation Of The Equipment. 5.3 The Detailed Description And Scope Of The Subject Of The Contract Was Specified In The Attached Interior Design Project (In Accordance With Annex 5 To Swz), Product Specification (According To Annex 6 To Swz) And Equipment Combinations (In Accordance With Attachments From 3A To 3E To Swz). The Contractor Is Obliged To Complete The Order On The Principles And Conditions Described In The Draft Contract. 5.4 The Equipment Used For The Arrangement Of Rooms In Which Children May Stay Must Be Adapted To The Age Range Of 1-3 Years. 5.5 The Cost Of Delivery And Unloading Of The Subject Of The Contract Is On The Contractors Side. The Subject Of The Contract Should Be Factory -New, Free From Defects, Correspond To The Quality Standards Specified In The Relevant Legal Acts, Have A Manufacturers Guarantees And Should Meet All The Requirements Provided For In Applicable Regulations For This Type Of Product And Cannot Be The Subject Of Third Party Claims. 5.7 In The Event Of The Unequivocal Patent Names, Trademarks, Materials, Products Or Devices Indicating The Manufacturer And Specific Catalog Types - All Such Names Should Be Read With The Or Equivalent Clause With The Same Or Not Worse Technical, Qualitative, Functional And Aesthetic Parameters Each Time. If Specific Types Of Materials, Products And Devices Are Given In The Above Documents, This Should Be Treated As An Auxiliary Indication Of The Minimum Quality Level (Standard). The Use Of Equivalent Materials Is Conditioned By Obtaining Quality Parameters And Functional Features At Least At The Level Indicated In The Description Of The Subject Of The Contract. In Such A Situation, The Employer Requires The Submission Of Relevant Documents To Make These Materials To Prove That The Quality Parameters And Utility Features Offered Are Balanced Or Better Than Submitted In The Documentation. Providing That The Materials, Items Or Goods Used Have Parameters Equal Or Better Than Materials, Items Or Goods Established In The Description Of The Subject Of The Contract Rests With The Contractor. The Employer Will Not Recognize Equivalent Solutions If They Are Worse Than Those Indicated In The Attachments To The Minimum Quality Specifications Of Qualitative, Functional, Technical And Technological Requirements.
