3 2. The Detailed Scope Of The Contract And The Implementation Conditions Are Specified In The Description Of The Subject Of The Contract Constituting Annex 8 To Swz. Other Terms Of The Contract Were Specified In The Contract Template, Constituting Annex 4 To Swz.3. The Tractor Offered By The Contractor Should Be Fully Functional, Free From Legal And Physical Defects And Should Meet The Technical, Quality And Functional Requirements Specified In The Detailed Description Of The Order. The Tractor Should Have All The Documents Necessary To Complete The Formalities Related To Allowing Public Roads And The Instruction Manual In Polish. The Tractor With Accessories Is Intended For Works Related To Maintaining Municipal Roads. 4. The Contracting Authority Requires That The Offered Subject Of The Contract Meet The Requirements Of Polish Traffic Regulations In Accordance With The Act Of 20 June 1997 Road Traffic Law (Journal Of Laws Of 2024, Item 1251), Had Current Approval Allowing For Allowing Traffic On Public Roads And In Accordance With The Act Of 14 April 2023 On Vehicle Approval Systems And Their Equipment (Journal Of Laws Of 2023 Item The Facts Must Be Given. The Approval Certificate Should Be Delivered At The Latest On The Day Of Delivery Of The Tractor. 5. During The Delivery Date Of The Tractor With Accessories, The User Manuals And Maintenance Of The Tractor, Devices And Equipment Mounted In The Tractor In Polish, Tractor Warranty Books And Equipment, Approval Certificate And A Set Of Documents Necessary To Register The Tractor, 6 Should Be Provided. 6. The Employer Allows The Possibility Of Offering Equipment And Devices With Equivalent Or Better Technical Parameters From The Terms Of The Contract Listed In The Specification. In This Case, The Contractor, Who Cites Equivalent Solutions To Those Described By The Employer, Is Obliged To Show That The Equipment And Devices He Offers Meet The Requirements Set By The Contracting Authority. The Basic Form Of Demonstrating That The Device Is Equivalent Or Characterized By Better Parameters Is To Present A Detailed Technical Specification. 7. The Ordering Party Does Not Allow Partial Offers Due To The Inability To Divide The Order In The Form Of One Vehicle. A Vehicle That Can Be Purchased Entirely Only From One Contractor. His Equipment (Sweeper, Plow, Mower, Sprinkler) Must Be Adapted And In Line With The Vehicle, And Therefore One Vehicle Must Be Provided By One Contractor. Lack Of Division Into Parts Will Not Reduce Competition. The Artificial Division Of The Order Into Parts Would Threaten Excessive Technical Difficulties And The Costs Of Performing The Order, As Well As The Need To Coordinate The Activities Of Various Contractors Implementing Individual Parts Of The Order.
