I. The Subject Of The Order Is: Successive Delivery Of Food Products To The School Canteen At The School Complex John Paul Ii In Smroków, The Słomniki Commune In The Second Half Of The School Year 2024/2025 Divided Into Tasking No. 1 - Dairy. The Scope Of The Subject Of The Order For All Tasks Includes The Successive Delivery Of Foodstuffs: 1. By Delivery, The Contracting Authority Understands The Cyclical Delivery Of The Goods On The Basis Of An Order Tailored To His Needs, Placed By The Authorized Person Of The Ordering Party. 2. Transport Of Articles Should Be Carried Out By Means Of Transport That Meets Sanitary Requirements (Including Activities Related To Loading And Unloading). 3. The Contractor Undertakes To Deliver The Goods To The Headquarters Of The Ordering Party By His Own Transport, At His Own Expense And His Own Risk, And To Flexible Response To Increased Or Decreased Needs Of The Ordering Party In Relation To A Given Assortment Or All Delivery. 4. Each Packaging Will Be Placed, Among Others Net Weight Recording And Shelf Life. 5. If The Goods Delivered By The Contractor Will Have Disadvantages (Poor Quality) Or Does Not Correspond In Terms Of Quantity, The Employer Will Inform About Possible Defects Or Quantitative Deficiencies, Immediately On The Day Of Receipt Of The Goods. 6. The Contracting Authority May Refuse To Accept Delivery In The Event Of Quantitative Deficiencies. Then It Is Recognized That The Contractor Did Not Meet The Delivery Date. 7. The Contractor Undertakes To Comply With The Applicable Hygiene And Sanitary Conditions In The Production, Storage And Delivery Of Goods, Which Is The Subject Of The Contract - For Which He Bears Full Responsibility. 8. The Employer Will Refuse To Accept The Goods From The Contractor Who Does Not Meet The Quality Or Quantitative Requirements. In Such A Situation, The Contractor Is Required To Replace The Goods With A Full -Fledged Or Complete Deficiencies Within 6 Hours. 9. The Contractor Guarantees Good Quality Of The Goods Delivered And Declares That The Food Supplies Delivered Are In The First Species With A Specific Expiry Date And The Features Given In The Price Form. 10. Deliveries Of The Goods Should Take Place On Business Days Between 8:00 And 14:00. The Date Of Delivery And Quantity Will Be Given The Contractors Each Time In The Form Of A Written Or Telephone Order At Least Two Days In Advance. 12. During The Implementation Of The Contract, The Employer May Carry Out Quantitative Shifts Of The Assortment According To The Current Needs And Purposefulness Of Their Purchase, Which Does Not Result In Financial And Legal Claims In Relation To The Contractor. 13. Failure To Perform The Full Quantitative Scope Of The Contract Does Not Give Rise To A Claim For The Purchase Of The Quantity Of Goods Not Realized During The Period Of The Contract. 14. The Contracting Authority Guarantees A Minimum Reception Of 50% Of Individual Articles. 15. All Foodstuffs Included In The Order And Off
