3.1.1 The Subject Of The Contract Is The Care And Maintenance Of Urban Greenery In Areas Owned By The Municipality Of Pionki. 3.1.2 As Part Of The Subject Of The Contract, Work Will Be Carried Out In Accordance With Annex 5 - Description Of The Subject Of The Contract. 3.1.3 The Contractor Performing The Contract Will Be Obliged To: 1 ) Proper Performance Of Works Covered By This Order On Time, In Accordance With Applicable Regulations, Gardening, Health And Safety Requirements And To Keep The Workplace In Purity And Order, 2) Performing Work In A Way That Does Not Cause Damage, Including The Threat To The Safety Of People And Property, And Providing Protection Justified Interests Of Third Parties, Under Pain Of Civil Liability For Damage, 3) Waste Export And Residue After Work, On Their Own And At Their Own Expense To Entities Authorized To Receive Them. The Contractor Undertakes To Perform All The Duties Of The Manufacturer And The Owner Of The Waste Within The Meaning Of The Waste Act And Is Obliged To Manage Waste Generated During The Implementation Of This Contract, In Accordance With The Act Of 14 December 2012 On Waste (I.E. Journal Of Laws Of 2023 . 1587, As Amended) Performed In Accordance With The Law, Applicable Polish And European Standards And The Principles Of Reliable Technical Knowledge. 3.1.5 For Traffic Safety Within The Section On Which The Works Will Be Carried Out, From The Moment The Works Will Be Carried Out, From The Moment Of Commencement Of Work, Until They Completed Their Completion On A Given Section, The Contractor Is Responsible .3.1.6Wszelkie Narzędzia, Materiały, Środki Niezbędne Do Realizacji Usługi Zapewnia Sobie Wykonawca Na Koszt Własny.3.1.7Wykonawca Zobowiązany Jest Do Użycia Materiałów Posiadających Odpowiednie Atesty, Normy Branżowe Oraz Na Żądanie Zamawiającego Okazania W Stosunku Do Wskazanych Materiałów Certyfikatów Bezpieczeństwa Lub Deklaracji Compliance With The Standards In Force In This Respect. 3.1.8 The Contractor Declares That All Materials And Products Necessary To Perform The Service Will Meet The Requirements Arising From The Provisions On Environmental Protection. 3.1.9 The Contractor Will Be Obliged To Perform Work With Due Care, With Particular Emphasis On Care O The Plant Remaining In Its Access. 3.1.10 The Contractor Is Obliged To Repair All Damage Caused In The Course Of This Contract To The Ordering Party As Well As In Relation To Third Parties, Including The Personnel Of The Ordering Party. Swz Is Described By Indicating A Trademark, Patent Or Origin, It Is Allowed To Be Equivalent To The Fact That The Proposed Solutions, Devices, Will Have Technical Parameters Not Worse Than Those Required By The Contracting Authority, Have The Required Approvals, Met The Required Standards. The Obligation To Clearly Demonstrate Their Equivalence, Compared To Those Adopted In The Design Assumptions, Rests With The Contractor.
