1. The Subject Of The Order Is The Supply Of An Agricultural Tractor, A Round Baler And A Fertilizer And Seeding Unit For The School Complex Of The Agricultural Education Center. Wincenty Witos In Mokrzeszów. The Ordering Party Informs That In The Further Text Of The Swz And In The Annexes, The Term Tractor Means An Agricultural Tractor, And The Term Machine Means A Round Baler And A Fertilizer And Seeding Unit.2. The Ordering Party Requires That The Tractor And Machines Constituting The Subject Of The Order Are: 1) Brand New, 2) Free From Manufacturing And Legal Defects, 3) Unused And Undamaged, 4) Manufactured In 2024.3. A Detailed Description Of The Technical Parameters Required By The Ordering Party Is Set Out In Annex No. 2 To The Swz - Description Of The Subject Of The Order (Hereinafter Also Referred To As Opz).4. As Part Of The Total Remuneration Offered, The Contractor, At His Own Expense And Risk, Is Obliged To Deliver The Tractor And Machines Constituting The Subject Of The Order To The Registered Office Of The Ordering Party, I.E. Mokrzeszów 111, 58-160 Świebodzice.5. The Contractor Is Obliged To Complete The Order On The Terms And Conditions Described In The Contract Template Constituting Annex No. 3 To Swz.6. The Ordering Party Requires A Minimum 24-Month Warranty For The Tractor And A Minimum 12-Month Warranty For The Round Baler And The Fertilizer And Seeding Unit, Subject To The Provisions Of Chapter Xxii. Swz Description Of The Offer Evaluation Criteria, Along With The Weights Of These Criteria And The Method Of Evaluation Of The Offers.7. The Ordering Party Requires That The Service And Repair Point Indicated By The Contractor, Where Warranty And Post-Warranty Inspections And Repairs Will Be Carried Out, Be Located At A Distance Of No More Than 100 Km From The Ordering Partys Headquarters. Distance Calculated On Public Roads. If A Service Is Indicated Outside Poland, The Contractor Will Be Obliged, At His Own Expense, To Provide The Ordering Party With A Translator In Order To Properly Guarantee Proper Communication During The Performance Of The Service Or Repair Service. If A Service And Repair Point Is Indicated At A Distance Greater Than 100 Km From The Ordering Partys Headquarters, The Costs Of Transporting The Tractor And/Or Machines Above This Distance Will Be Borne By The Contractor.8. The Ordering Party Does Not Reserve The Obligation For The Contractor To Personally Perform Key Parts Of The Order.9. The Contractor May Entrust The Performance Of Part Of The Order To A Subcontractor(S).10. The Ordering Party Requires That In The Event Of Entrusting Part Of The Order To Subcontractors, The Contractor Should Indicate In The Offer The Parts Of The Order Whose Performance It Intends To Entrust To Subcontractors And Provide (If Known To It At This Stage) The Names (Companies) Of These Subcontractors.
