The Awarding Of A Concession For Services Is Considered To Be The Conclusion Of A Payment Contract In Which The Contracting Authority A) Assigns The Provision Of Activities To The Supplier, While The Suppliers Consideration Consists In The Right To Take Benefits Resulting From The Provision Of Services In The Form Of Payments, And B) The Contracting Authority Transfers To The Supplier The Operational Risk Associated With Taking The Benefits Resulting From The Provision Services. The Transfer Of Operational Risk Occurs If, Under Normal Market Conditions, The Supplier Is Not Guaranteed The Return Of The Costs Incurred During The Provision Of Services That Are The Subject Of The Concession. At The Same Time, It Can Also Be A Partial Transfer Of Operational Risk, If The Part Of The Operational Risk Transferred To The Supplier Includes Actual Exposure To Market Fluctuations So That Any Estimated Losses To The Supplier Are Not Merely Negligible. In This Procurement Procedure, The Contracting Authority Selects The Operator Of A Total Of 9 Local Heat Sources (Also Equipment) Owned By The Municipality Of Brno-Sever, With Whom It Will Conclude A Concession Contract. The Future Operator (Concessionaire) Will Have These Heat Sources Leased From The Client And Will Operate Them, I.E. Will Ensure The Supply Of Heat And Domestic Hot Water (Dhw) To The Take-Off Points Connected To These Devices, Will Carry Out Their Reconstruction And Will Carry Out Repairs, Maintenance And Revisions Of The Devices So That They Are In Perfect Operable Condition And Meet All Legal Requirements And Technical Standards And Will Also To Ensure The Provision Of Emergency Services And Consultancy Activities. The Devices Are And Will Remain The Property Of The Client. The Subject Of The Performance Of The Awarded Public Contract Is Therefore: 1) Lease 9 Equipment By The Client Concessionaire 2) Operation 9 Equipment, Production And Distribution Of Thermal Energy By The Concessionaire, 3) Implementation Of Reconstruction 9 Equipment By The Concessionaire Incl. Ensuring The Processing Of Project Documentation 4) Carrying Out Routine Repairs, Maintenance And Servicing And Revisions Of 9 Equipment By The Concessionaire 5) Provision Of Emergency Service For 9 Heat Sources By The Concessionaire 6) Carrying Out Repairs By The Concessionaire 7) Provision Of Consultancy Activities By The Concessionaire To The Client
