Task No. 1 – Purchase And Delivery Of Municipal Tractors With 3 Pieces Of Equipment. The Basic Scope Includes Tractors Equipped With A Snow Plow (With The Required Additional Equipment Enabling Its Installation At The Front Of The Tractor), A Motyl Type Sand Spreader, A Drum Mower And A Rear-Mounted Sweeper With A Basket And A Sprinkler. Detailed Requirements Are Specified In Annex 3.1 To The Swz. 2. The Vehicle Parameters Described In Annex No. 3.1-3.2 To The Swz Constitute The Minimum Requirements Of The Ordering Party. Failure To Meet The Minimum Requirements Will Result In Rejection Of The Offer As Inconsistent With The Terms Of The Contract Pursuant To Art. 226 Section 1 Point 5 Of The Public Procurement Law. 3. The Ordering Party Does Not Agree To Change The Delivered Product Range To One Other Than That Offered In The Offer Form Constituting Annex No. 1 To The Swz, Subject To Point 4. 4. The Ordering Party Agrees To Change The Delivered Product Range To One Other Than That Offered. In The Offer Form In Cases Where The Contractor Demonstrates That The Offered Product Range Has Been Withdrawn From Sale Or Its Production Has Been Discontinued, There Is No Access To It On The Polish Market (Confirmed By The Manufacturer Or Sales Representative On The Polish Market), The Ordering Party Allows The Possibility Of Offering And Delivering A Different Product Range Provided That Its Technical Parameters Are Not Worse Than Those Of The Offered Product, And The Price Is Not Higher Than That Offered In The Offer Form.4.1 In The Case Referred To In Point 4, The Contractor Must Obtain The Ordering Partys Consent To Change The Offered Product.4.2 The Ordering Party Has The Right Not To Consent To Change The Offered Assortment. In Such A Case, The Contractor Will Be Obliged To Deliver The Offered Assortment Consistent With The Content Of The Offer.4.3 The Ordering Party Will Provide The Consent Or Lack Thereof Referred To In Point 4.1 Or Point 4.2 In Writing To The Contractor. 5. The Ordering Party Requires That The Offered Vehicle Be Brand New, Class I, Unused, Unregistered, Manufactured No Earlier Than In 2022, Free From Manufacturing And Legal Defects, Admitted To Trading, Meet The Quality And Performance Standards Required By Law, Meet Polish And European Safety Requirements, And The Requirements For Driving On Public Roads, In Accordance With The Provisions Of The Road Traffic Law (Consolidated Text: Journal Of Laws Of 2023, Items 1047, 919, 1053, 1088, 1123, 1193, 1234, 1394, 1720, 1723, 2029, Of 2024, Item 834) And Indicated By The Ordering Party In Annex No. 3.1-3.2 To The Swz. 6. The Ordering Party Requires The Contractor To Indicate The Make, Model, Version, Year Of Production, Symbol Or Other Additional Data Enabling Clear Identification Of The Offered Vehicle In Annex No. 1 To The Swz (Offer Form).
