Prior Information Notice For Public Transport Services By Railways – Direct Award Of A Public Service Contract For Public Passenger Transport Services In Regular Services With Trams On The Tram 25 Süd Großhesseloher Brücke Line To Grünwald, Derbolfinger Platz. The State Capital Of Munich (Lhm) Is The Responsible Authority In Accordance With Art. 8 Para. 3 Bayöpnvg In Conjunction With Section 8A Pbefg And Art. 2 Lit. C) Regulation (Ec) No. 1370/2007. It Intends To Directly Award A Public Service Contract (Ödla) For The Period From December 14, 2025 To June 30, 2047 For Public Passenger Transport Services On Tram Line 25 (South) To The Münchner Verkehrsgesellschaft (Mvg, Emmy-Noether-Straße 2, 80992 Munich, E-Mail: Wicher.Juergen@Swm.De, Telephone: +49 89 21910, Fax: +49 89 2191702168). The Subject Of The Intended Ödla Is The Operation Of The Section Of Line 25 From Großhesseloher Brücke To Grünwald, Derbolfinger Platz. The Ödla Obliges To Provide Transport Services And Operate The Rail Infrastructure. In Total, According To The Current Planning Status, The Transport Services To Be Awarded At The Start Of Operations Amount To Around 306,000 Train Kilometers Per Year. The Ödla Will Contain Requirements Regarding Timetables, Transport Charges And Standards Of The Transport Services Covered (See Vi.3.B). The Operator Is Granted An Exclusive Right For Transport Within The Limits Of Section 8A Paragraph 8 Pbefg. The Ödla Will Contain Regulations According To Which The Transport Offer Can Be Adapted To Changing Transport Needs Or Financial Conditions And To The Local Transport Plans In The Currently Applicable Version As Well As To Other Changed Circumstances Within The Framework Specified In The Ödla. With This Prior Information, The Lhm Complies With The Publication Obligation In Accordance With Section 8A Paragraph 2 Pbefg In Conjunction With Article 7 Paragraph 2 Of Regulation (Ec) No. 1370/2007. This Prior Information Also Represents A Notice In Accordance With Section 135 Paragraph 3 Sentence 1 No. 2 Gwb. The Reason For The Clients Decision To Award The Contract Without Prior Publication Of A Separate Contract Notice In The Eu Official Journal Is That A Permissible There Is An In-House Award According To Section 108 Gwb, Which According To Art. 12 Directive 2014/24/Eu, Art. The Lhm Exercises Control Over The Mvg As If It Were Its Own Department. In Addition, More Than 80 Percent Of The Mvgs Activities Serve To Carry Out Tasks With Which It Has Been Entrusted By The Lhm. There Is No Private Equity Investment In Mvg. The Ödla Can Be Awarded After One Year (Art. 7 Para. 2 Regulation (Ec) No. 1370/2007).
