A Detailed Description Of The Subject Of The Order Is Included In The Document Price Form/Description Of The Subject Of The Order/List Of Required Parameters - Annex No. 1 To The Swz, Which Is Also A Price Form. 3. The Delivered Roll Must Meet The Specifications Specified In The Description Of The Subject Of The Order And The Contractors Offer, And In Particular Be A Device: A) Brand New, Not Previously The Subject Of Exhibitions Or Expositions, Not Showing Any Traces Of Use, Manufactured No Earlier Than 2023, Technically Efficient , Without External Defects, Complete And Ready For Use As Intended; B) Not Subject To The Rights Of Third Parties, Free From Physical And Legal Defects, Of Good Quality, Originating From The Manufacturers Legal Distribution Channel And Approved For Distribution And Use In Poland; C) In Accordance With The Conditions Resulting From Applicable Legal Provisions And The Standards And Quality Standards Applicable In The Industry For This Type Of Devices; D) Having All Legally Required Certificates, Approvals, Permits, Etc. Authorizing The Use Of The Device; E) Having Full Documentation And Accessories Necessary For Use, I.E. In Particular: Operation And Maintenance Manual, Declaration Of Conformity, Warranty Conditions And A Document Specifying The Technical Inspection Schedule, All Prepared In Polish. Accessories Are Understood As All Devices Necessary For Proper Ongoing Operation; If The Accessories Require Permanent Installation, The Contractor Undertakes To Deliver And Install Them. 4. The Parameters And Requirements Indicated In The Opz Specify The Minimum Technical, Operational, Utility, Quality And Functional Conditions That The Subject Of The Order Delivered To The Ordering Party Is To Meet. 5. The Ordering Party Does Not Allow The Submission Of Variant Offers And Requires The Submission Of An Offer Consistent With The Subject Of The Order, Described In Annex No. 1 To The Swz. 5. In The Case Of Materials Or Products Mentioned In The Documentation Describing The Subject Of The Order By Indicating Trademarks, Such Indication Should Be Treated As An Example. The Ordering Party Allows In Accordance With Art. 99 Section 5 Of The Public Procurement Law, The Use Of Materials Or Products Equivalent In Quality And Functionality (With Equivalent Or Higher Parameters). If The Contractor Offers Equivalent Materials Or Products, He Is Obliged To Clearly Demonstrate That The Equivalent Materials Or Products He Offers Meet The Requirements Specified By The Ordering Party. Before Using The Product/Installing The Device, The Contractor Should Always Obtain The Customers Approval. In The Case Of References To Standards, Technical Assessments, Technical Specifications And Technical Reference Systems, The Ordering Party Allows Solutions Equivalent To Those Described. 6. The Ordering Party Informs That Where The Ordering Party Has Described The Subject Of The Order By Reference To Standards, European Technical Assessments, Approvals, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Section 1 Point 2 And Section 3 Of The Public Procurement Act, The Contracting Authority Indicates That It Allows Solutions Equivalent To Those Described. A Contractor Who Refers To Solutions Equivalent To Those Described By The Ordering Party Is Obliged To Demonstrate That The Supplies Or Services He Offers Meet The Requirements Specified By The Ordering Party. 7. The Contractor May Entrust The Execution Of Part Of The Order To A Subcontractor. 8. The Ordering Party Will Not Investigate Whether There Are Grounds For Exclusion Indicated In This Tor Against A Subcontractor Who Is Not An Entity Providing Resources.
