Casino Operating Services – Interim Approval For Casino Operations In Lower Saxony. The Interim Approval Authorizes The Operation Of Up To Ten Casinos In Lower Saxony. With Regard To The Gaming Operation, It Is Important That Large Games (Roulette, Poker, Black Jack Or Similar) Are Offered In Addition To Slot Machines. The Previous Operator’S Approval Ends On August 31, 2024. The Operational Gaming Operations Of The Casinos Should Begin As Seamlessly As Possible On September 1St, 2024. The Interim License Is Granted Exclusively For The Purpose Of Enabling Gaming Operations In Lower Saxony As Long As The Regular Casino License, Which Was Granted To Msbn Projekt Gmbh & Co. Kg By Decision Of November 15, 2023 And Which Is Currently Being Challenged Before The Hanover Administrative Court, Is Not Valid Is Effective And Enforceable. As Soon As The Suspensive Effect Of This Action No Longer Applies - Whether Through A Court Decision On The Legal Dispute, Whether Through An Order For Immediate Enforcement By The Casino Supervisory Authority Or By The Administrative Court - The Effectiveness Of The Interim Approval Also Expires. This Can Also Be Done Before September 1St, 2024. In Addition, The Interim Approval Is Limited To One Year, So It Ends On August 31, 2025 At The Latest. The Approval Procedure Is Based On The Provisions Of The Lower Saxony Casino Act (Nspielbg) Of December 16, 2004, Last Amended By Article 9 Of The Law Of December 14, 2023 (Nds. Gvbl. P. 320) As Well As The Requirements And Provisions Described In More Detail Below. This Is Not A Tendering Procedure Within The Meaning Of Section 3 Paragraph 1 Nspielbg, But Rather The Granting Of An Interim Approval In Accordance With Section 3 Paragraph 11 Nspielbg, Which Is Carried Out By Means Of A Tender For Reasons Under Union Law, Even If The Wording Of Section 3 Paragraph 11 Nspielbg Does Not Require A Tender. The Casino Supervisory Authority Reserves The Right To Change Or Terminate The Approval Process At Any Time Without Giving Reasons. There Is No Legal Right To Carry Out The Admission Process Or To Participate In The Admission Process. Likewise, There Is No Legal Right To The Granting Of Interim Approval Or To Compensation If An Interim Approval That May Have Been Granted Does Not Become Effective, Becomes Ineffective Before The End Of The One-Year Period Or Is Revoked. Costs For Preparing The Application Will Not Be Reimbursed.
