The Subject Of The Order Is The Purchase And Delivery Of A Brand New Single-Shaft Shredder To The Ordering Partys Headquarters. The Scope Of The Subject Matter Consists Of The Basic Order And The Order Covered By Option Rights. 1.1. Basic Scope Of The Subject Of The Order: • Delivery And Transport Of A Mobile, Slow-Speed, Single-Shaft Shredder, • Carrying Out Full Service Training For The Designated Staff Of The Ordering Party, Approximately 10 People, • Carrying Out An Operational Test To Confirm Compliance With Performance Requirements, • Performing Services Within A Period Of 24 Months Or 2000 Mth, Depending On What Comes First, In Accordance With The Provisions In The Operation And Maintenance Manual. More Information And Requirements Are Included In The Annex To This Swz - Detailed Description Of The Subject Of The Order. 1.2. Scope Covered By The Option Law: • Additional Set Of Shredding Knives And Counter Knives With Fastening Elements • Warranty/Service Inspections Of The Shredder In Accordance With The Machines Operation And Maintenance Manual • Consumables Necessary For Warranty/Service Inspections 1.3. The Ordering Party Has The Right To Exercise The Provided Option Right Within 30 Days Of Signing This Contract. After This Deadline, The Ordering Party Will Not Be Able To Exercise The Option Right. 1.4. Exercising The Option Right Is Not Obligatory. If The Ordering Party Does Not Exercise The Option Right, The Contractor Shall Not Be Entitled To Any Claim In This Respect. 1.5. The Ordering Party Reserves The Right To Exercise The Option Right To An Incomplete/Selected Extent. 1.6. The Condition For The Activation Of The Option Right Is The Submission By The Ordering Party Of A Declaration Of Will To Exercise The Option Right And Its Scope. 2. If The Swz/Draft Contract Contains The Name Of The Manufacturer Or Company, The Ordering Party Reserves The Right To Use Other Equivalent Materials, But With Parameters No Worse Than Those Described In The Swz/Draft Contract. 2.1 Pursuant To Art. 101 Section 4 Of The Pzp, The Ordering Party Allows Solutions Equivalent To Those Described In The Swz By Means Of Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Section 1 Point 2 And Section 3 Pzp, If They Allow To Obtain Features Or Parameters Not Worse Than Those Mentioned. 2.2 Pursuant To Art. 101 Section 5 Of The Pzp, The Contractor Who Refers To Solutions Equivalent To Those Described By The Ordering Party Is Obliged To Prove In The Offer That The Proposed Solutions Meet The Requirements Specified In The Description Of The Subject Of The Order To An Equivalent Extent. 2.3 Whenever The Swz Indicates A Material Trademark, Patent Or Origin, Source Or Specific Process That Characterizes The Products Or Services Provided By A Specific Contractor, The Contractor May Use The Indicated Or Equivalent Other Material That Meets The Technical Requirements Indicated By The Ordering Party. Whenever This Specification Describes The Subject Of The Contract Using Standards, Approvals, Technical Specifications And Reference Systems, The Ordering Party Allows Solutions
