The Contractor Will Provide Service And Assistance In Using The Furnaces In The First Heating Season After Acceptance Of The Works.6B. During The Implementation Of The Subject Of The Order, The Contractor Will Ensure The Participation Of: - A Person With Qualifications As A Master In The Chimney Sweeping Craft, - A Person With A Category E Qualification Certificate Authorizing Him To Operate Group 1 Devices And Networks At The Operation Position, - A Person Entered In The Central Register Of Energy Performance Of Buildings, Authorized For The Preparation Of Energy Performance Certificates. 7. The Ordering Party Indicates That In The Documentation Referred To In Points 1-4 Above), The Building At Śledziówka 8 Is Named: Śledziówka 8 Lok. No. 1, And The Building At Śledziówka 8A Is Located Under The Name Śledziówka 8 Lok. No. 2.8. The Ordering Party Also Provides Bills Of Quantities And Drawings For Each Part Of The Procedure, Which Are Of An Auxiliary Nature (Annex No. 1E To The Swz [.Zip File]). 9. The Contractor May Not Use Errors Or Omissions Contained In The Indicated Documentation And Should Immediately Notify The Ordering Party Of Their Detection, Who Will Make Appropriate Corrections Or Changes. The Data Specified In The Attached Documentation Are Considered Target Values In Which Changes Are Permitted As Part Of The Arrangements With The Ordering Party.10. The Contractor Is Obliged To Verify The Provided Solutions, And In The Event Of Discrepancies In The Designed Solutions, The Contractor Will Not Claim Any Rights To Additional Remuneration.11 .The Contractor Is Obliged To Include In The Valuation And Offer Supplies And Additional Costs That May Occur During Construction Works Such As Those Being The Subject Of This Investment. 12. Note: The Works Will Be Carried Out In Used Residential Premises. The Area Of The Works Must Be Properly Secured And Marked. 13. It Is Recommended That The Contractor, Before Submitting The Offer, Conducts An On-Site Inspection Of The Work Sites And Their Surroundings At His Own Expense. Regardless Of The Warranty Granted For Construction Works And Installed Devices, Which Is The Criterion For Evaluating The Offers, The Contractor Is Liable To The Ordering Party Under The Warranty For Defects, On The Terms Specified In The Civil Code, I.E. The Contractor Is Liable Under The Warranty If A Physical Defect Is Detected Within Two Years In The Case Of The Installed Devices And Within Five Years For Construction Works. The Above Deadlines Are Counted From The Date Of Final Acceptance Of The Works.15. The Law Applicable To This Order (Including The Contract Concluded As A Result Of This Procedure And For The Assessment Of The Legal Effects Of All Documents In This Order) Is Polish Law, Taking Into Account The Law Of The European Union.16. In All Provisions Of The Swz And Its Annexes In Which The Ordering Party Refers To Standards, Approvals, Technical Specifications Or Reference Systems Or Indicates Trademarks, Parameters Or Sources Of Origin (Names Of Manufacturers Or Devices), In Accordance With Art. 99 Section 5 And Art. 101 Section 4 Of The Public Procurement Act, The Ordering Party Allows Equivalent Solutions. 17. If The Description Of The Subject Of The Order Includes The Names Of Materials And Products Of Specific Manufacturers, This Should Be Treated Only As A Definition Of The Desired Standard And Quality. In All Such Situations, The Contractor May Offer Equivalent Materials And Products With At Least The Same Technical And Quality Parameters. Product Equivalence Means Offering A Product Whose Technical Parameters Of The Materials Used, Efficiency, Durability And Quality Are Not Inferior To The Quality Of The Materials And Products Described In The Swz.18. The Contractor Who Refers To Equivalent Solutions Is Obliged To Demonstrate That The Solutions He Offers The Solution Meets The Requirements Specified By The Ordering Party.
